Tabii bu genel ifade bazen \u00f6yle abart\u0131l\u0131 bir bi\u00e7imde anlat\u0131l\u0131r ki, dinleyenler neredeyse \u00c7erkeslerde hi\u00e7 su\u00e7 i\u015flenmedi\u011fi, toplumda hi\u00e7bir problem olmad\u0131\u011f\u0131 hayat\u0131n g\u00fcll\u00fck g\u00fclistanl\u0131k oldu\u011fu yan\u0131lg\u0131s\u0131na d\u00fc\u015ferler. Elbette \u00c7erkeslerde de iyi ve k\u00f6t\u00fc vard\u0131, h\u0131rs\u0131zl\u0131k cinayet adaletsizlikler vard\u0131. Fakat toplum o d\u00f6nemlerde bu g\u00fcn bile \u00e7ok medeni ka\u00e7an y\u00f6ntemlerle \u00e7\u00f6z\u00fcyordu bu t\u00fcr meselelerini.<\/p>\n<p>Bu t\u00fcr cemiyet i\u00e7i sorunlarda i\u015fleyen mekanizmay\u0131 ve kurallar\u0131 MAFEDZ Serebiy \u2018Adige Xabze\u2019 isimli kitab\u0131nda detayl\u0131ca anlat\u0131yor.<\/p>\n<p>Bu kurallardan, \u00f6zellikle toplumdaki anla\u015fmazl\u0131k ve uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fc ile ilgili olanlardan \u015f\u00f6yle bahsediyor Serebiy:<br \/>\n\u00c7erkeslerde hapishane yoktu, fakat o i\u015fi g\u00f6ren ba\u015fka mekanizmalar, xabzeler vard\u0131.<\/p>\n<p>O \u00c7erkesler ki \u00e7ocuk 7 ya\u015f\u0131na girdi\u011fi andan itibaren beline kama takard\u0131 ve ya\u015f\u0131 ne olursa olsun asla o kama bir daha belden \u00e7\u0131kmazd\u0131.<\/p>\n<p>Kendisini erkek sayan her Adige&#8217;nin belinde kama olmas\u0131, erke\u011fin silah ta\u015f\u0131mas\u0131 eski \u00c7erkeslerde xabze idi. E\u011fer yasta de\u011filse, cenazesi yoksa bir erke\u011fin belinde kamas\u0131 olmadan bah\u00e7e kap\u0131s\u0131ndan d\u0131\u015far\u0131 ad\u0131m atmas\u0131 bile \u00e7ok ay\u0131p say\u0131l\u0131rd\u0131.<\/p>\n<p>Buna ra\u011fmen Adigelerde durup dururken silaha davranmak, \u00e7ok ge\u00e7erli bir nedeni olmad\u0131k\u00e7a silah \u00e7ekmek de ayn\u0131 derecede ay\u0131plan\u0131rd\u0131 ve bu \u00e7ok nadir rastlanan bir \u015feydi cemiyette.<\/p>\n<p>Bu disiplin ise k\u00f6ylerdeki ya\u015fam bi\u00e7imlerinin xabze kurallar\u0131 \u00fczerine y\u00fcr\u00fcyor olmas\u0131ndan ve bu kurallar\u0131n herkes i\u00e7in ba\u011flay\u0131c\u0131 olmas\u0131ndan kaynaklan\u0131yordu.<\/p>\n<p>Aileyi ba\u011flayan kurallar, mahalleyi ba\u011flayan kurallar, k\u00f6y\u00fc ve b\u00f6lgeyi ba\u011flayan kurallar vard\u0131.<\/p>\n<p>Bu kurallar her aile, mahalle, k\u00f6y veya b\u00f6lge, k\u0131sacas\u0131 b\u00fct\u00fcn cemiyet i\u00e7in ge\u00e7erliydi. Herkes kurallara sadece uymakla de\u011fil ayn\u0131 zamanda korumakla da y\u00fck\u00fcml\u00fcyd\u00fc.<\/p>\n<p>Tabii ki her \u015feye ra\u011fmen bu kurallara uymayanlar, yalan s\u00f6yleyenler, ay\u0131p i\u015fleyenler h\u0131rs\u0131zl\u0131k ars\u0131zl\u0131k yapanlar da oluyordu cemiyette fakat zaten xabzeyi gerekli k\u0131lan xabzenin g\u00fczelli\u011fini belirginle\u015ftiren \u015feylerdi bunlar sadece.<\/p>\n<p>Cemiyetin ezici bir \u00e7o\u011funlu\u011fu xabze d\u0131\u015f\u0131na \u00e7\u0131kmaz bu ortak kurallar\u0131 ya\u015fam\u0131nda uygulard\u0131.<\/p>\n<p>Artniyet g\u00fctmeksizin herkes kendisine yak\u0131\u015fan\u0131 yapar, kendi g\u00fcc\u00fc oran\u0131nda kom\u015fusuna soyda\u015f\u0131na yard\u0131m eder, hi\u00e7 kimse bir ba\u015fkas\u0131na zarar verecek bir i\u015fe kalk\u0131\u015fmazd\u0131 bilerek.<\/p>\n<p>Yard\u0131mlar kar\u015f\u0131l\u0131k beklemeksizin yap\u0131l\u0131r, gen\u00e7ler cemiyetin t\u00fcm\u00fc taraf\u0131ndan e\u011fitilirdi.<\/p>\n<p>Kendisi bir kazan\u00e7 sa\u011flam\u0131\u015fsa bir \u015feyden fayda g\u00f6rm\u00fc\u015fse, mutlaka yak\u0131n\u0131ndakine kom\u015fu hakk\u0131 g\u00f6t\u00fcr\u00fcrd\u00fc insanlar.<\/p>\n<p>K\u00f6y\u00fcn y\u00f6neticisinin ald\u0131\u011f\u0131 kararlar uygulan\u0131r, ya\u015fl\u0131lara her daim sayg\u0131 g\u00f6sterilirdi ve herkes bu kurallara uyard\u0131.<\/p>\n<p>Ne zaman ki bu ya\u015fam bi\u00e7iminin e\u015fitlik\u00e7i olmad\u0131\u011f\u0131, cemiyetteki bir kesimin di\u011ferini kulland\u0131\u011f\u0131 veya basit g\u00f6rd\u00fc\u011f\u00fc, bu t\u00fcr toplu kurallar\u0131n ki\u015fi \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc s\u0131n\u0131rlad\u0131\u011f\u0131 gibi d\u00fc\u015f\u00fcnceler ortaya at\u0131lmaya ba\u015fland\u0131, i\u015fte o zaman xabze toplumdaki de\u011ferini kaybetti, onunla da kalmad\u0131 yok olup gitti.<\/p>\n<p>\u201c\u0130nsanlar birbirini dinlemeden anlamadan kendi do\u011frusuna giderse, birisinin elindekini di\u011feri g\u00f6z\u00fcn\u00fc k\u0131rpmadan kaparsa, yumru\u011fu g\u00fc\u00e7l\u00fc olan kurallar\u0131 koyarsa,y\u00fczs\u00fcz pi\u015fkin ars\u0131z olan itibar g\u00f6r\u00fcrse, ister aile olsun ister cemiyet olsun o toplulu\u011fun \u00f6mr\u00fc uzun olmaz\u201d diyor Serebiy.<\/p>\n<p>A\u015fa\u011f\u0131da daha ziyade kavga anla\u015fmazl\u0131k cinayet gibi meselelerin \u00e7\u00f6z\u00fcm\u00fc konusunda y\u00fcr\u00fcyen xabze ile ilgili bilgiler bulacaks\u0131n\u0131z.<\/p>\n<p>Kavga ve cinayet gibi aileler aras\u0131 anla\u015fmazl\u0131klar:<\/p>\n<p>Bir \u015fekilde k\u00f6yde bir kavga bir cinayet olmu\u015fsa \u00f6nce k\u00f6y\u00fcn ya\u015fl\u0131lar\u0131 devreye girerlerdi.<\/p>\n<p>Olu\u015fturulan ya\u015fl\u0131lar heyeti \u00f6nce kendi aralar\u0131nda adil olacaklar\u0131na dair yemin ederdi ve etti\u011fi yeminden d\u00f6nm\u00fc\u015f ki\u015fi de g\u00f6r\u00fclmemi\u015ftir bu g\u00fcne kadar.<\/p>\n<p>Bu \u015fekilde olu\u015fturulan mahkeme heyeti problemi \u00e7\u00f6z\u00fcnceye kadar, \u00f6ncelikle aras\u0131nda kavga olan iki s\u00fclaleye k\u00f6y\u00fcn yollar\u0131n\u0131 payla\u015ft\u0131r\u0131rlard\u0131.<br \/>\nKavgal\u0131 iki aile bireylerinin de gezece\u011fi yerler, ge\u00e7ece\u011fi yollar belirlenerek durum kendilerine bildirilir, b\u00f6ylece aras\u0131nda problem olan aile fertlerinin kar\u015f\u0131la\u015fmas\u0131 \u00f6nlenirdi.<\/p>\n<p>E\u011fer mevcut problem \u00e7ok tehlikeli ve riskliyse, veya hatal\u0131 g\u00f6r\u00fclen taraf s\u00fcrekli sald\u0131rganl\u0131kta bulunan ars\u0131z bir aile de\u011filse, ya\u015fl\u0131lar heyeti o s\u00fclalenin b\u00fcy\u00fcklerini \u00e7a\u011f\u0131rarak ikinci kez bu t\u00fcr bir olayla gelmemeleri konusunda uyar\u0131r, haks\u0131zl\u0131\u011fa u\u011frayan taraf i\u00e7in tazminat belirlerlerdi.<br \/>\nOlayda yaralanan veya \u00f6len varsa, yine bu ya\u015fl\u0131lar heyeti zarar g\u00f6ren ki\u015fi i\u00e7in kan paras\u0131 tayin eder bunu di\u011fer tarafa \u00f6detirdi.<\/p>\n<p>E\u011fer \u00f6len ki\u015finin k\u00fc\u00e7\u00fck \u00e7ocuklar\u0131 varsa o \u00e7ocuklar yeti\u015finceye kadar bak\u0131mlar\u0131n\u0131 hatal\u0131 g\u00f6r\u00fclen taraf\u0131n \u00fcstlenmesine karar verilirdi.<\/p>\n<p>Bu t\u00fcr bir kavga sonucu \u00f6l\u00fcm olmam\u0131\u015f fakat, yaral\u0131 ve i\u015f g\u00f6remez durumda ma\u011fdur kimseler olmu\u015fsa, zarara u\u011frayan ki\u015finin tedavisini ve iyile\u015finceye kadar evinin odun su yiyecek gibi ihtiya\u00e7lar\u0131n\u0131 hatal\u0131 g\u00f6r\u00fclen ki\u015finin veya s\u00fclalesinin \u00fcstlenmesine karar verilirdi.<\/p>\n<p>Bu t\u00fcr problemler ya\u015fl\u0131lar taraf\u0131ndan \u00e7\u00f6z\u00fcme ba\u011flan\u0131ncaya kadar kavgal\u0131 ailelerden iki ki\u015fi bir \u015fekilde kar\u015f\u0131la\u015f\u0131rsa birbirlerinden uzak durmalar\u0131, icap ederse yollar\u0131n\u0131 de\u011fi\u015ftirmeleri gerekiyordu \u00c7erkes xabzesine g\u00f6re.<br \/>\nBu t\u00fcr durumlarda genellikle de haks\u0131zl\u0131\u011fa u\u011frayan taraf olurmu\u015f yolunu de\u011fi\u015ftiren.<\/p>\n<p>Fakat bunun nedeni eski zamanlarda ya\u015fayan Temir Kasbot\u2019tan rivayetle \u015f\u00f6yle anlat\u0131l\u0131r:<\/p>\n<p>\u0130ki ailenin aras\u0131nda kan davas\u0131 olmu\u015fsa, zarar g\u00f6ren ailenin ya\u015fl\u0131s\u0131 kendi s\u00fclalesindeki herkesi toplar ve onlara \u015f\u00f6yle tembihlermi\u015f:<br \/>\n\u201cBu g\u00fcn hasm\u0131m\u0131z olan s\u00fclalede e\u011fer ger\u00e7ekten s\u00f6z\u00fc ge\u00e7en ya\u015fl\u0131 olsayd\u0131, xabze olsayd\u0131 b\u00f6ylesi bir olay ba\u015f\u0131m\u0131za gelmezdi.Bu cemiyette xabze var, ya\u015fl\u0131lar\u0131m\u0131z var ve onlar\u0131n alaca\u011f\u0131 kararlar ge\u00e7erlidir.<\/p>\n<p>Bu karar al\u0131n\u0131ncaya ya\u015fl\u0131lar bu i\u015fe el at\u0131p \u00e7\u00f6z\u00fcnceye kadar, \u015fu andan itibaren i\u00e7inizden hi\u00e7 kimse hasm\u0131m\u0131z ile kar\u015f\u0131la\u015fmayacak, e\u011fer bir yerlerde rastla\u015f\u0131rsan\u0131z yolunuzu de\u011fi\u015ftirin, tart\u0131\u015fmay\u0131n sald\u0131rmay\u0131n muhatap olmay\u0131n.Hakl\u0131yken haks\u0131z \u00e7\u0131kmayal\u0131m.\u201d<\/p>\n<p>Haks\u0131z durumda olan s\u00fclalenin ya\u015fl\u0131s\u0131 da kendi s\u00fclalesini bir araya toplar onlar\u0131 \u015fu \u015fekilde uyar\u0131rm\u0131\u015f:<br \/>\n\u201cArt\u0131k olan oldu. Ortal\u0131kta \u00e7ok fazla dola\u015fmay\u0131n,hasm\u0131m\u0131zla kar\u015f\u0131la\u015fmamaya \u00e7al\u0131\u015f\u0131n. E\u011fer hasm\u0131m\u0131z bir sald\u0131r\u0131da bulunur, evimizi basmaya kalkarsa ac\u0131madan vurmakta serbestiniz.Bunun d\u0131\u015f\u0131nda kendinizi koruyun dikkat edin ve al\u0131nacak karar\u0131 bekleyin\u201d.<\/p>\n<p>Her ne kadar ya\u015fl\u0131lar kendi ailelerini kontrol etmeye \u00e7al\u0131\u015fsa da, zaman zaman bu t\u00fcr bask\u0131nlar oldu\u011fu olurmu\u015f kavgal\u0131 aileler aras\u0131nda.<br \/>\nBuna \u00c7erkesce de wunaje y\u043d\u0430\u0436\u044d deniliyor.<\/p>\n<p>Fakat bu t\u00fcr bir \u00f6fkeye kap\u0131lan,bu t\u00fcr bir hata yaparak hasm\u0131na bask\u0131na yeltenen aile masum bile olsa sald\u0131rgan taraf durumuna d\u00fc\u015ft\u00fc\u011f\u00fc i\u00e7in,bu ho\u015f kar\u015f\u0131lanmaz ve bask\u0131na yeltenen aile \u00e7o\u011fu kez hakl\u0131yken haks\u0131z duruma bile d\u00fc\u015febiliyormu\u015f.<\/p>\n<p>O nedenle bu t\u00fcr olaylarda olu\u015fturulan ya\u015fl\u0131lar heyetinin karar\u0131 beklenir, onlar\u0131n karar\u0131 netle\u015fip taraflar uzla\u015ft\u0131r\u0131l\u0131ncaya kadar iki has\u0131m s\u00fclale birbiri ile kar\u015f\u0131la\u015fmamaya dikkat edermi\u015f.<\/p>\n<p>George longvorth an\u0131lar\u0131nda bu konudan bahsederken;<br \/>\n\u201cBu meselede taraflar o kadar dikkatli o kadar temkinli davran\u0131rlard\u0131 ki, \u00c7erkes xabzesini bilmeden g\u00f6zlem yapan bir ki\u015fi bunu rahatl\u0131kla has\u0131mlar\u0131n korkakl\u0131\u011f\u0131na cesaretsizli\u011fine verebilirdi, fakat i\u015fin asl\u0131 \u00f6yle de\u011fildir.<\/p>\n<p>E\u011fer iki ki\u015fi aras\u0131nda bu t\u00fcr olay olmu\u015fsa, art\u0131k o sorun ki\u015filerin de\u011fil s\u00fclalelerin aras\u0131nda bir mesele say\u0131l\u0131yordu.<\/p>\n<p>E\u011fer ki\u015fi bir ba\u015fkas\u0131n\u0131 \u00f6ld\u00fcrm\u00fc\u015f,yaralam\u0131\u015f mal\u0131n\u0131 \u00e7alm\u0131\u015f veya benzer bir zarar vermi\u015fse onun cevab\u0131n\u0131 b\u00fct\u00fcn s\u00fclale veriyordu ve \u00e7o\u011fu kez de haks\u0131z olan tarafa kar\u015f\u0131ya verdi\u011fi zarar misli misli \u00f6detiliyordu.<\/p>\n<p>Dolay\u0131s\u0131yla ki\u015filer kendi ba\u015flar\u0131na hareket edemiyorlard\u0131,b\u00f6yle hareket edenler \u00e7\u0131karsa da kendi s\u00fclalesi onu d\u0131\u015fl\u0131yor ve yapayaln\u0131z b\u0131rak\u0131yordu.\u201d diyor.<\/p>\n<p>B\u00fct\u00fcn bu olaylar\u0131n i\u00e7erisinde bir \u00f6nemli detay vard\u0131; hi\u00e7 bir su\u00e7u yokken sald\u0131r\u0131ya u\u011frayan, pusu kurularak \u00f6ld\u00fcr\u00fclen tamamen masum bir insan\u0131n \u00f6c\u00fc mutlaka al\u0131n\u0131r, hi\u00e7bir \u015fekilde bunun aff\u0131 olmazd\u0131.<\/p>\n<p>Yine Longvorth \u015f\u00f6yle yaz\u0131yor bu konuda:<br \/>\n\u201cT\u00fcfek tabanca ve kaman\u0131n erkek k\u0131yafetinin bir par\u00e7as\u0131 say\u0131ld\u0131\u011f\u0131 bu toplumda, silah\u0131n herkese bir g\u00fcven bir cesaret verdi\u011fini g\u00f6rebiliyorsunuz.<br \/>\nFakat \u00f6te yandan ayn\u0131 ki\u015filer o bellerindeki silah\u0131n boyunlar\u0131na y\u00fckledi\u011fi sorumlulu\u011fun \u00e7ok iyi fark\u0131ndalar ve o nedenle de buna uygun davran\u0131yorlar genellikle.\u201d<\/p>\n<p>Yukar\u0131da anlat\u0131lanlara \u00f6rnek vermek gerekirse : E\u011fer bir ki\u015fi bir cinayet i\u015fler ve onun mahkemesi g\u00f6r\u00fcl\u00fcp kan bedeli \u00f6detildikten sonra bu t\u00fcr bir olay\u0131n tekrar\u0131 olursa, ya\u015fl\u0131lar o s\u00fclalenin ya\u015fl\u0131lar\u0131n\u0131 \u00e7a\u011f\u0131r\u0131rlar ve \u015fu kural\u0131 bildirirler kendilerine: \u201cArs\u0131z\u0131n\u0131z\u0131 kendi kuyunuza g\u00f6m\u00fcn, cezas\u0131n\u0131 kendiniz verin.\u201d<\/p>\n<p>Hi\u00e7bir s\u00fclale bu karar\u0131 uygulamazl\u0131k edemezdi.<\/p>\n<p>E\u011fer b\u00f6yle bir \u015fey olursa o ailenin d\u00fc\u011f\u00fcn\u00fcne cenazesine girilmemek \u00fczere karar al\u0131n\u0131r ve aileye k\u00f6y terk ettirilirdi.<\/p>\n<p>Bununla ilgili eski kaynaklarda \u00f6rnekler de vard\u0131r.<\/p>\n<p>Mesela bir s\u00fclalenin, tekrar tekrar su\u00e7 i\u015fleyen kendi o\u011fullar\u0131ndan birisini ya\u015fl\u0131lar heyetinin karar\u0131 ile boynuna ta\u015f ba\u011flayarak nehre att\u0131klar\u0131n\u0131 anlatan bir olay vard\u0131r eski yaz\u0131l\u0131 belgeler aras\u0131nda.<\/p>\n<p>Kaza ile \u00f6l\u00fcme sebep olmak:<\/p>\n<p>Kazaen bir insan\u0131n \u00f6ld\u00fcr\u00fcld\u00fc\u011f\u00fc olaylarda ise ba\u015fka bir xabze uygulan\u0131yordu.<\/p>\n<p>Bu xabzeye mate p\u0131lhe \u041c\u0430\u0442\u044d \u043f\u044b\u043b\u044a\u044d deniliyordu.<\/p>\n<p>\u00d6rne\u011fin, ki\u015fi bir kavgay\u0131 ay\u0131r\u0131rken veya bir masumu korumak isterken sald\u0131rgan\u0131n \u00f6l\u00fcm\u00fcne neden olmu\u015fsa, iki s\u00fclale aras\u0131na kan davas\u0131 girmemesi i\u00e7in kendi evinin bah\u00e7e kap\u0131s\u0131 yan\u0131nda bir sopaya bo\u015f bir sepeti tepe \u00fcst\u00fc takar \u00e7eker gidermi\u015f k\u00f6y\u00fcnden.<\/p>\n<p>Bunun anlam\u0131, \u201cben bir adam \u00f6ld\u00fcrd\u00fcm ama bilerek isteyerek veya d\u00fc\u015fmanl\u0131k nedeni ile olmu\u015f bir \u015fey de\u011fil, tamamen kaza ile \u00f6l\u00fcme sebep oldum fakat sald\u0131rgan ve hatal\u0131 olan taraf \u00f6len ki\u015fiydi\u201d demekmi\u015f.<\/p>\n<p>B\u00f6yle yap\u0131p giden bir ki\u015finin s\u00fclalesine d\u00fc\u015fmanl\u0131k eden cemiyette haks\u0131z g\u00f6r\u00fcl\u00fcrd\u00fc.<\/p>\n<p>Fakat \u00f6l\u00fcme neden olan ki\u015fi bir yerlerde bir \u015fekilde yakalan\u0131rsa kana kan m\u0131 olur, kan bedeli mi al\u0131n\u0131r, art\u0131k o \u00f6l\u00fc sahibinin vicdan\u0131na kalm\u0131\u015f bir \u015feydi.<\/p>\n<p><b>Ki\u015fiyi a\u015fa\u011f\u0131lamak:<br \/>\n<\/b><br \/>\nBir insana kam\u00e7\u0131 veya sopa ile vurmak hele hele \u00e7i\u011f et ile y\u00fcz\u00fcne vurmak \u00e7ok a\u015fa\u011f\u0131lay\u0131c\u0131 bir hareket olarak g\u00f6r\u00fcl\u00fcrm\u00fc\u015f \u00c7erkeslerde ve bu durumda kama \u00e7ekilirmi\u015f.<\/p>\n<p>Bu \u015fekilde y\u00fcz\u00fcne \u00e7i\u011f et ile vurulan bir ki\u015finin kamas\u0131n\u0131 \u00e7ekerek kar\u015f\u0131s\u0131ndakini \u00fcstten a\u015fa\u011f\u0131ya do\u011frad\u0131\u011f\u0131 ve sonra da matep\u0131lhe yaparak \u00e7ekip gitti\u011fi anlat\u0131l\u0131r eskiler taraf\u0131ndan.<\/p>\n<p>Yine bir ba\u015fka olayda gen\u00e7 \u00e7oban\u0131n dalg\u0131nl\u0131\u011f\u0131na gelmedi\u011fi ve s\u00fcr\u00fcn\u00fcn bir adam\u0131n ekinine girdi\u011fi, ekin sahibinin \u00f6fke ile gelip \u00e7obana sopa ile vurdu\u011fundan bahsedilerek; \u00e7oban\u0131n \u201cben hayvan m\u0131y\u0131m bana nas\u0131l sopa ile vurursun\u201d diye kamas\u0131n\u0131 \u00e7ekerek adam\u0131 yaralad\u0131\u011f\u0131 anlat\u0131l\u0131r.<\/p>\n<p>Ya\u015fl\u0131lara havale olan bu olayda,kurulan mahkemenin \u00e7oban\u0131 hakl\u0131 g\u00f6rerek yaralanan adam\u0131 su\u00e7lu \u00e7\u0131kartt\u0131\u011f\u0131 belirtiliyor.<\/p>\n<p>B\u00f6yle durumlarda taraflar aras\u0131nda darg\u0131nl\u0131k olmamas\u0131 i\u00e7in ayn\u0131 mahkeme \u00f6n\u00fcnde hatal\u0131 olan\u0131n kafas\u0131 hakl\u0131 bulunana t\u0131ra\u015f ettirilirdi.<\/p>\n<p>Hatal\u0131 olan da bir sofra donatarak iki taraf\u0131nda kat\u0131ld\u0131\u011f\u0131 bir ziyafet verir, bu \u015fekilde i\u015f tatl\u0131ya ba\u011flan\u0131rd\u0131.<\/p>\n<p><b>H\u0131rs\u0131zl\u0131k:<\/p>\n<p><\/b>Bir h\u0131rs\u0131zl\u0131k olur da mal sahibi \u00e7al\u0131nan mal\u0131n\u0131n izini s\u00fcrerek bir k\u00f6ye kadar girerse, o mal\u0131 k\u00f6y\u00fcn b\u00fct\u00fcn\u00fc ya bulup teslim etmekle veya hep birlikte \u00f6demekle y\u00fck\u00fcml\u00fcyd\u00fc.<\/p>\n<p><b>Gizli \u015fahitlik:<\/p>\n<p><\/b>Bu t\u00fcr bir h\u0131rs\u0131zl\u0131k yapan ki\u015fiyi g\u00f6ren olur da mal sahibine durumu bildirirse, mal sahibi o ki\u015finin \u015fahitli\u011fini ba\u015fka \u00fc\u00e7 adama daha dinletirdi, fakat hepsi birlikte ki\u015finin ad\u0131n\u0131 a\u00e7\u0131klamayacaklar\u0131na yemin ederlerdi.<\/p>\n<p>Mahkemeye bu \u00fc\u00e7 ki\u015fi \u015fahidin s\u00f6ylediklerini duyduklar\u0131na dair isim a\u00e7\u0131klamadan bilgi verirlermi\u015f.<\/p>\n<p><b>\u0130ki topluluk aras\u0131ndaki sorunun \u00e7\u00f6z\u00fcm\u00fc:<br \/>\n<\/b><br \/>\n\u0130ki k\u00f6y veya kabile aras\u0131nda bir sorun \u00e7\u0131km\u0131\u015f bir anla\u015fmazl\u0131k olmu\u015fsa, meselenin \u00e7\u00f6z\u00fcm\u00fc konusunda Adige t\u00f6resi \u00e7ok \u00f6nemli bir \u00f6rnek te\u015fkil eder.<\/p>\n<p>Bu t\u00fcr anla\u015fmazl\u0131klarda olay\u0131n taraf\u0131 olan her k\u00f6y veya topluluk, kendisini temsil edecek, d\u00fcr\u00fcstl\u00fc\u011f\u00fcne insanl\u0131\u011f\u0131na g\u00fcvenilen, itimat edilen ve her zaman do\u011frudan yana olabilecek ki\u015filerden olu\u015fan birer vekil heyeti se\u00e7erdi \u00f6ncelikle.<\/p>\n<p>Daha sonra bu iki heyet her iki k\u00f6ye de ayn\u0131 mesafede olacak \u015fekilde belirlenmi\u015f bir yerde toplan\u0131rd\u0131.
