D\u00fcnyada totalitarizmin borusunun \u00f6tt\u00fc\u011f\u00fc bir d\u00f6nemde devlet, bu mottoya uygun davranmada herhangi bir zorlukla kar\u015f\u0131la\u015fmad\u0131. Devletteki bu de\u011fi\u015fim i\u00e7selle\u015ftirilmi\u015f ve do\u011fal bir de\u011fi\u015fim de\u011fildi; aksine g\u00f6n\u00fcls\u00fcz ve zorunlu bir de\u011fi\u015fimdi. Bu nedenle de\u011fi\u015fim kar\u015f\u0131s\u0131nda devlet iki \u015fekilde direniyor ve direndik\u00e7e de yanl\u0131\u015flara s\u00fcr\u00fckleniyor:<br \/>\n<strong><br \/>\nI) <\/strong>\u0130lki, klasik &#8216;Tando\u011fan zihniyeti&#8217;ni, yani her de\u011fi\u015fim talebi ve zorlamas\u0131 kar\u015f\u0131s\u0131nda, devletin kendini de\u011fi\u015fimin tek ta\u015f\u0131y\u0131c\u0131s\u0131 ve \u00f6znesi haline getirme \u00e7abas\u0131n\u0131 devreye soktu. &#8216;Mademki de\u011fi\u015fim ka\u00e7\u0131n\u0131lmaz; o halde de\u011fi\u015fimi ben yapar, ne kadar de\u011fi\u015filece\u011fine ben karar veririm&#8217; zihniyeti, anadilde yay\u0131n konusunda da kendisini g\u00f6sterdi.<\/p>\n<p><strong> AB ittirmesi<\/strong><\/p>\n<p>AB uyum s\u00fcrecinin ittirmesiyle, anadilde yay\u0131n\u0131n \u00f6n\u00fcndeki engellerin kald\u0131r\u0131lmas\u0131 zorunlulu\u011fu do\u011funca, devlet, bu t\u00fcr yay\u0131nlar\u0131 da ba\u015fkas\u0131na b\u0131rakmad\u0131 ve TRT&#8217;de, &#8216;K\u00fclt\u00fcrel Zenginli\u011fimiz&#8217; ad\u0131 alt\u0131nda farkl\u0131 dil ve leh\u00e7elerde program yay\u0131n\u0131na ba\u015flad\u0131. Bu, \u00f6nemli bir s\u0131k\u0131nt\u0131y\u0131 da beraberinde getirdi. Zira imparatorluk bakiyesi olan bu toplumda \u00e7ok say\u0131da anadil ve leh\u00e7e konu\u015fulmakta. Devletin bu anadil ve leh\u00e7elerin hepsinde yay\u0131n yapmas\u0131 m\u00fcmk\u00fcn de\u011fil.<\/p>\n<p>Bu durumda devlet, zorunlu olarak, diller aras\u0131nda bir se\u00e7ime gidecek baz\u0131 dilleri se\u00e7ip onlarda yay\u0131n yaparken, geri kalanlar\u0131 ise bundan mahrum b\u0131rakacakt\u0131r. Hangi kriterler g\u00f6zetilerek b\u00f6yle bir se\u00e7ime gidilece\u011fi sorunu \u00f6nemli bir sorundur. Ama daha \u00f6nemlisi, devletin yay\u0131n yapt\u0131\u011f\u0131 dilleri konu\u015fanlar\u0131n belirli bir ayr\u0131cal\u0131\u011fa sahip k\u0131l\u0131nmas\u0131 kar\u015f\u0131s\u0131nda, yay\u0131n d\u0131\u015f\u0131 b\u0131rak\u0131lan dilleri konu\u015fanlar\u0131n ise kendilerini d\u0131\u015flanm\u0131\u015f hissetmeleridir. (Nitekim TRT&#8217;nin uygulamas\u0131 bunu do\u011frular: TRT, Bo\u015fnak\u00e7a, Arap\u00e7a, K\u0131rmanci, \u00c7erkezce ve Zazaca program yay\u0131mlamaya ba\u015flad\u0131. Bunun \u00fczerine Lazlar, kendi dillerinde yay\u0131n yap\u0131lmamas\u0131n\u0131 sert dille ele\u015ftirdiler.)<br \/>\nBu, devletin me\u015fruluk temellerini zedeler; \u00e7\u00fcnk\u00fc devlet, ancak farkl\u0131 toplumsal kesimlere e\u015fit mesafede bulundu\u011fu \u00f6l\u00e7\u00fcde me\u015frulu\u011funu idame ettirebilir. Oysa burada bu ilkenin bariz bir ihlali s\u00f6z konusudur.<br \/>\n<strong><br \/>\nII)<\/strong> Temel bir hakk\u0131n tan\u0131nmas\u0131, ve \u00f6zellikle bu hakk\u0131n yo\u011fun olarak K\u00fcrtler taraf\u0131ndan kullan\u0131lmas\u0131, g\u00fcndeme geldi\u011finde devletin standart hale gelen bir davran\u0131\u015f\u0131 var:<\/p>\n<p>Bu hakk\u0131 yasayla tan\u0131mak ama kullan\u0131m\u0131n\u0131 y\u00f6netmeliklerle imk\u00e2ns\u0131z k\u0131lmak. Anadilde yay\u0131n meselesi, bu davran\u0131\u015f\u0131n tipik bir \u00f6rne\u011fini olu\u015fturuyor. \u015e\u00f6yle ki; farkl\u0131 dil ve leh\u00e7elerde yay\u0131n, &#8216;T\u00fcrk Vatanda\u015flar\u0131n\u0131n G\u00fcnl\u00fck Ya\u015famlar\u0131nda Geleneksel Olarak Kulland\u0131klar\u0131 Farkl\u0131 Dil ve Leh\u00e7elerde Yap\u0131lacak Radyo ve Televizyon Yay\u0131nlar\u0131 Hakk\u0131nda Y\u00f6netmelik&#8217;e g\u00f6re yap\u0131l\u0131yor. (Y\u00f6netmeli\u011fin ismindeki yarat\u0131c\u0131l\u0131\u011fa dikkatinizi \u00e7ekerim.) Y\u00fcr\u00fcrl\u00fck ve y\u00fcr\u00fctme maddeleriyle birlikte toplam 13 madde olan 25. 01. 2004 tarihli bu y\u00f6netmelik, farkl\u0131 dil ve leh\u00e7elerdeki yay\u0131na ili\u015fkin \u00fc\u00e7 \u00f6nemli s\u0131n\u0131rlama ihtiva eder:<\/p>\n<p><strong>a. Yay\u0131nc\u0131 a\u00e7\u0131s\u0131ndan:<\/strong> Y\u00f6netmelikte, ancak ulusal yay\u0131n lisans\u0131na sahip radyo ve TV kurulu\u015flar\u0131n\u0131n farkl\u0131 dil ve leh\u00e7elerde yay\u0131n yapabilece\u011fi belirtilmi\u015f; yerel yay\u0131n yapan radyo ve televizyonlara ise bu hak tan\u0131nmam\u0131\u015ft\u0131r.<br \/>\n<strong>b. \u0130\u00e7erik a\u00e7\u0131s\u0131ndan:<\/strong> Y\u00f6netmelikte, farkl\u0131 dil ve leh\u00e7elerdeki yay\u0131nlar\u0131n sadece yeti\u015fkinlere y\u00f6nelik olmas\u0131; bu dil ve leh\u00e7elerin \u00f6\u011fretimine y\u00f6nelik yay\u0131n yap\u0131lmamas\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<br \/>\n<strong>c. S\u00fcre a\u00e7\u0131s\u0131ndan:<\/strong> Y\u00f6netmeli\u011fe g\u00f6re, radyolar g\u00fcnde 60 dakikay\u0131 a\u015fmamak \u00fczere haftada 5 saat, televizyonlar g\u00fcnde 45 dakikay\u0131 a\u015fmamak \u00fczere haftada 4 saat yay\u0131n yapabilecektir.<\/p>\n<p>Anadilde yay\u0131n\u0131 fiilen imk\u00e2ns\u0131z hale getiren bu y\u00f6netmeli\u011fe kar\u015f\u0131 iki dava a\u00e7\u0131ld\u0131. Diyarbak\u0131r Barosu&#8217;nun, y\u00f6netmeli\u011fin 4. maddesi, 5. maddesinin 2, 3, 4 ve 5. f\u0131kralar\u0131, 6. maddesinin a bendi ve ge\u00e7ici 1. maddesinin iptali ve y\u00fcr\u00fctmenin durdurulmas\u0131 istemiyle a\u00e7t\u0131\u011f\u0131 dava Dan\u0131\u015ftay taraf\u0131ndan,<br \/>\n&#8216;Baro dava ehliyetine sahip olmad\u0131\u011f\u0131&#8217; gerek\u00e7esiyle reddedildi. Diyarbak\u0131r&#8217;da yerel yay\u0131n yapan G\u00fcn TV&#8217;nin a\u00e7t\u0131\u011f\u0131 dava ise halen Dan\u0131\u015ftay&#8217;\u0131n \u00f6n\u00fcnde. E\u011fer bu davada da iptal \u00e7\u0131kmazsa, farkl\u0131 dillerdeki yay\u0131nlara ili\u015fkin s\u0131n\u0131rlamalar devam edecek.<\/p>\n<p>B\u00fcnyesinde bu s\u0131n\u0131rlamalar\u0131 ta\u015f\u0131yan bir y\u00f6netmelikle, anadilde yay\u0131n yapabilmenin imkan\u0131 yoktur. Reklam gelirleriyle ya\u015fayan ulusal radyo ve televizyonlar\u0131n, sadece belirli bir kesimin ilgi g\u00f6sterece\u011fi bir anadil veya leh\u00e7ede yay\u0131n yapmayaca\u011f\u0131 a\u015fik\u00e2rd\u0131r. Yaparlarsa reklam gelirlerini kaybeder ve varl\u0131klar\u0131n\u0131 devam ettiremezler. Anadilde yay\u0131n, ancak yerel yay\u0131n yapan radyo ve televizyonlar arac\u0131l\u0131\u011f\u0131yla yap\u0131labilir. Y\u00f6netmelikte oldu\u011fu gibi, bu kurulu\u015flar\u0131n yay\u0131n yapmas\u0131n\u0131 engellemek, asl\u0131nda anadilde yay\u0131n yap\u0131lmas\u0131n\u0131 fiilen yasaklamakla e\u015fanlaml\u0131d\u0131r. \u00d6te yandan, sadece yeti\u015fkinlere y\u00f6nelik olup \u00e7ocuklar\u0131 g\u00f6zetemeyen, yay\u0131n yap\u0131lan dili \u00f6\u011fretemeyen ve yar\u0131m saatle s\u0131n\u0131rland\u0131r\u0131lan bir yay\u0131na ne kadar yay\u0131n denebilir, o da ayr\u0131 bir sorun.<\/p>\n<p><strong> Yasak\u00e7\u0131l\u0131\u011f\u0131n i\u015flevsel yan\u0131 yok<\/strong><\/p>\n<p>Kald\u0131 ki, bu s\u0131n\u0131rlay\u0131c\u0131 ve yasak\u00e7\u0131 tutumun i\u015flevsel bir taraf\u0131 da yok. Bug\u00fcn \u00fclkenin en yoksul kesimlerinin ya\u015fad\u0131\u011f\u0131 semtlerde dahi \u00e7at\u0131lar dijital \u00e7anak antenlerle dolu. Bu antenler sayesinde, bir K\u00fcrt, Bo\u015fnak, Ermeni, G\u00fcrc\u00fc, vb., d\u00fcnyan\u0131n neresinde yap\u0131l\u0131rsa yap\u0131ls\u0131n, kendi anadilindeki yay\u0131nlara son derece rahat bir bi\u00e7imde ula\u015f\u0131yor. Dolay\u0131s\u0131yla, \u00e7a\u011f\u0131n ileti\u015fim olanaklar\u0131 kar\u015f\u0131s\u0131nda bu \u00f6zg\u00fcrl\u00fck korkusunun, bu yasak sevicili\u011finin pek bir h\u00fckm\u00fc kalm\u0131yor; ama komik ka\u00e7t\u0131\u011f\u0131 da muhakkak.<\/p>\n<p>Bu itibarla yap\u0131lmas\u0131 gereken bellidir: Devletin, \u00fclkedeki t\u00fcm anadillerde ve dahi leh\u00e7elerde hizmet verme zorunlulu\u011fu yoktur.
