Aral\u0131k 1921&#8217;de Abhazya SSC ve G\u00fcrcistan SSC, Abhazya ve G\u00fcrcistan aras\u0131nda devlet-hukuk ili\u015fkilerinin esas\u0131n\u0131 olu\u015fturan Birlik antla\u015fmas\u0131n\u0131 imzalad\u0131lar. Bu antla\u015fmaya g\u00f6re G\u00fcrcistan Sovyet Sosyalist Cumhuriyeti ve Abhazya Sovyet Sosyalist Cumhuriyeti aralar\u0131nda askeri, siyasi ve mali-ekonomik birli\u011fe giriyordu. Bundan sonra Abhazya SSC, SSCB&#8217;nin kurulu\u015funa kat\u0131ld\u0131 ve temsilcileri Transkafkasya Federasyonu b\u00fcnyesinde Aral\u0131k 1922&#8217;de SSCB&#8217;nin kurulu\u015f anla\u015fmas\u0131n\u0131 imzalad\u0131lar.<\/p>\n<p>&nbsp;<\/p>\n<p>1931 y\u0131l\u0131nda Abhazya SSC, G\u00fcrcistan SSC i\u00e7inde \u00f6zerk SSC&#8217;ne d\u00f6n\u00fc\u015ft\u00fcr\u00fcld\u00fc. Ancak 1977 SSCB Anayasas\u0131&#8217;na g\u00f6re \u00f6zerk cumhuriyetler devlettiler; kendi anayasalar\u0131, y\u00fcksek yasama, y\u00fcr\u00fctme ve yarg\u0131 organlar\u0131 vard\u0131. Bu ama\u00e7la, 1989&#8217;dan 1991&#8217;e kadar olan d\u00f6nemde G\u00fcrcistan Y\u00fcksek Sovyet&#8217;i tek tarafl\u0131 olarak bir dizi karar ald\u0131. Buna kar\u015f\u0131l\u0131k Abhazya \u00d6SSC Y\u00fcksek Sovyet&#8217;i, bu faaliyetlerin Abhazya&#8217;n\u0131n devlet yap\u0131s\u0131n\u0131 tehlikeye att\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnerek 25 A\u011fustos 1990&#8217;da Abhazya&#8217;n\u0131n Devlet Egemenli\u011fi Deklarasyonu&#8217;nu ve Abhazya&#8217;n\u0131n devlet yap\u0131s\u0131n\u0131n korunmas\u0131n\u0131n hukuki garantileri hakk\u0131ndaki karar\u0131 kabul etti.\u00a0Son belgede ayr\u0131ca, G\u00fcrcistan SSC Y\u00fcksek Sovyet&#8217;i taraf\u0131ndan al\u0131nan kararlar\u0131n sonucunda, Abhazya&#8217;n\u0131n G\u00fcrcistan&#8217;a dahil olmas\u0131n\u0131n hukuki dayanaklar\u0131n\u0131 yitirdi\u011fi tespit ediliyordu.<\/p>\n<p>&nbsp;<\/p>\n<p>Abhazya ile G\u00fcrcistan aras\u0131nda devlet-hukuk ili\u015fkileri antla\u015fma temelinde ortaya \u00e7\u0131kt\u0131\u011f\u0131ndan, G\u00fcrcistan tek tarafl\u0131 olarak Abhazya ile kar\u015f\u0131l\u0131kl\u0131 ili\u015fkilerinin karakterini de\u011fi\u015ftiremezdi. Ayr\u0131ca bu, birlik cumhuriyetlerinin ve \u00f6zerk cumhuriyetlerin ili\u015fkilerini d\u00fczenleyen SSCB yasalar\u0131yla da \u00e7eli\u015fiyordu. Bu \u015fekilde, G\u00fcrcistan Y\u00f6netimi&#8217;nin faaliyetleri G\u00fcrcistan ve Abhazya aras\u0131ndaki devlet-hukuk ili\u015fkilerini kopma noktas\u0131na getirdi.<\/p>\n<p>&nbsp;<\/p>\n<p>Zviad Gamsahurdiya&#8217;n\u0131n iktidara gelmesinden sonra, 1990 y\u0131l\u0131 sonunda G\u00fcrcistan Cumhuriyeti Y\u00fcksek Sovyet&#8217;i taraf\u0131ndan G\u00fcrcistan&#8217;\u0131n devlet ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n yeniden kurulmas\u0131na y\u00f6nelik ge\u00e7i\u015f d\u00f6nemi ilan edildi. 28 \u015eubat 1991&#8217;de ise G\u00fcrcistan&#8217;\u0131n devlet ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n 26 May\u0131s 1918 tarihli ba\u011f\u0131ms\u0131zl\u0131k s\u00f6zle\u015fmesi temelinde yeniden kurulmas\u0131 i\u00e7in referandum ilan edildi, ki bu pratikte SSCB&#8217;den ayr\u0131lma karar\u0131yd\u0131.<\/p>\n<p>&nbsp;<\/p>\n<p>3 Nisan 1990 tarihli, G\u00fcrcistan&#8217;\u0131n hen\u00fcz SSCB i\u00e7inde bulundu\u011fu d\u00f6nemde kabul edilen &#8220;Birlik cumhuriyetinin SSCB&#8217;den ayr\u0131lmas\u0131yla ilgili sorunlar\u0131n \u00e7\u00f6z\u00fclme d\u00fczeni hakk\u0131ndaki&#8221; SSCB yasas\u0131na g\u00f6re, \u00f6zerk cumhuriyetler, birlik cumhuriyetinin SSCB&#8217;den ayr\u0131lmas\u0131 durumunda, SSCB&#8217;de kalma ve kendi devlet-hukuk stat\u00fcleri konusunda serbest\u00e7e karar verme hakk\u0131na sahiptiler. Buna ba\u011fl\u0131 olarak, Abhazya, 17 Mart 1991 tarihinde yap\u0131lan ve cumhuriyet n\u00fcfusunun \u00e7o\u011funlu\u011funun SSCB&#8217;nin korunmas\u0131 y\u00f6n\u00fcnde fikir belirtti\u011fi referanduma kat\u0131ld\u0131.<\/p>\n<p>&nbsp;<\/p>\n<p>Abhazya \u00d6SSC&#8217;nin referandum sonu\u00e7lar\u0131 SSCB referandum merkez komisyonu taraf\u0131ndan resmi olarak onayland\u0131. Ayn\u0131 s\u0131rada, ba\u011f\u0131ms\u0131z devlet kurma arzusunu belirten G\u00fcrcistan bu referanduma kat\u0131lmad\u0131. 31 Mart 1991&#8217;de G\u00fcrcistan topraklar\u0131nda, G\u00fcrcistan&#8217;\u0131n devlet ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n yeniden kurulmas\u0131 hakk\u0131nda Abhazya&#8217;n\u0131n kat\u0131lmad\u0131\u011f\u0131 bir referandum yap\u0131ld\u0131.<\/p>\n<p>&nbsp;<\/p>\n<p>9 Nisan 1991&#8217;de bu referandum sonu\u00e7lar\u0131na dayanarak G\u00fcrcistan Y\u00fcksek Sovyet&#8217;i &#8220;G\u00fcrcistan&#8217;\u0131n devlet ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n yeniden kuruldu\u011funa dair s\u00f6zle\u015fme&#8221;yi kabul etti. Buna g\u00f6re G\u00fcrcistan, 1918-1919 y\u0131llar\u0131ndaki G\u00fcrcistan Cumhuriyeti&#8217;nin hukuki halefi ilan ediliyordu. Bu andan itibaren G\u00fcrcistan SSC&#8217;nin hukuki varl\u0131\u011f\u0131 sona eriyordu. Bu \u015fekilde, eski G\u00fcrcistan SSC topraklar\u0131nda birbirinden ayr\u0131 iki devlet ortaya \u00e7\u0131kt\u0131: Ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 ve SSCB&#8217;den ayr\u0131ld\u0131\u011f\u0131n\u0131 ilan eden G\u00fcrcistan ve SSCB&#8217;nin \u00f6znesi olarak kalmaya devam eden Abhazya&#8230; Dolay\u0131s\u0131yla, SSCB yasalar\u0131yla kurulan ve d\u00fczenlenen Abhazya ve G\u00fcrcistan aras\u0131ndaki devlet-hukuk ili\u015fkileri keza SSCB yasalar\u0131 temelinde sona eriyordu.<\/p>\n<p>SSCB&#8217;nin da\u011f\u0131ld\u0131\u011f\u0131 ana kadar (21 Aral\u0131k 1991) Abhazya onun \u00f6znesi olarak kald\u0131, bu s\u0131fatla SSCB&#8217;nin reforme edilmesinin m\u00fczakere edildi\u011fi g\u00f6r\u00fc\u015fmelere kat\u0131ld\u0131. Abhazya Y\u00fcksek Sovyet&#8217;i Ba\u015fkan\u0131 SSCB da\u011f\u0131ld\u0131\u011f\u0131 ana kadar g\u00f6revi itibar\u0131 ile SSCB Federasyon Konseyi&#8217;nin ve SSCB Y\u00fcksek Sovyet&#8217;i Prezidyumu&#8217;nun \u00fcyesiydi. Ayn\u0131 zamanda Abhazya, G\u00fcrcistan devlet ba\u015fkanl\u0131\u011f\u0131 se\u00e7imlerine ve onun iktidar organlar\u0131n\u0131n \u00e7al\u0131\u015fmas\u0131na kat\u0131lm\u0131yordu. Abhazya&#8217;n\u0131n ayn\u0131 anda hem SSCB&#8217;nin hem de ba\u011f\u0131ms\u0131z G\u00fcrcistan&#8217;\u0131n \u00f6znesi olamayaca\u011f\u0131 a\u00e7\u0131kt\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p>Buradan da \u015fu sonu\u00e7 \u00e7\u0131k\u0131yor ki, G\u00fcrcistan&#8217;\u0131n BM&#8217;e kabul edildi\u011fi ana kadar Abhazya ile hi\u00e7bir ili\u015fkisi yoktu ve BM taraf\u0131ndan G\u00fcrcistan&#8217;\u0131n toprak b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn 21 Aral\u0131k 1991&#8217;deki eski G\u00fcrcistan SSC s\u0131n\u0131rlar\u0131yla tan\u0131nmas\u0131 hukuki dayanaklar\u0131n\u0131 yitirmi\u015fti. G\u00fcrcistan&#8217;\u0131n BM&#8217;e al\u0131nmas\u0131n\u0131n arifesinde Abhazya Cumhuriyeti Y\u00fcksek Sovyet&#8217;i Ba\u015fkan\u0131 Vladislav Ardz\u0131nba, BM Genel Sekreteri&#8217;ne g\u00f6nderdi\u011fi mektupta Abhazya ve G\u00fcrcistan aras\u0131nda devlet-hukuk ili\u015fkisi olmad\u0131\u011f\u0131 ve G\u00fcrcistan&#8217;\u0131n BM&#8217;e eski G\u00fcrcistan SSC s\u0131n\u0131rlar\u0131yla kabul edilmesinin hukuka uygun olmad\u0131\u011f\u0131 konusunu dile getirmi\u015fti.<\/p>\n<p>&nbsp;<\/p>\n<p>SSCB&#8217;nin da\u011f\u0131lmas\u0131ndan sonra, \u015eubat 1992&#8217;de G\u00fcrcistan Ge\u00e7ici Askeri Konseyi, Abhazya ile ili\u015fkilerin tespit edilmedi\u011fi 1921 G\u00fcrcistan Demokratik Cumhuriyeti Anayasas\u0131&#8217;na ge\u00e7me karar\u0131 ald\u0131. Bununla birlikte G\u00fcrcistan Y\u00f6netimi taraf\u0131ndan, Abhazya ile ili\u015fkilerin ge\u00e7ici olarak, yeni bir model haz\u0131rlan\u0131ncaya kadar \u00f6nceki prensiplerle kurulaca\u011f\u0131 bildirildi. Bu Anayasa&#8217;n\u0131n II. B\u00f6l\u00fcm\u00fc&#8217;ne g\u00f6re Abhazya, uluslararas\u0131 hukukun \u00f6znesi, egemen bir devlet say\u0131l\u0131yordu. Ayn\u0131 zamanda Abhazya Parlamentosu, federasyon antla\u015fmas\u0131 temelinde e\u015fit \u00f6zneli ili\u015fkilerin kurulmas\u0131 i\u00e7in g\u00f6r\u00fc\u015fmelere ba\u015flama teklifiyle G\u00fcrcistan Y\u00f6netimi&#8217;ne \u00e7a\u011fr\u0131da bulundu. Ancak G\u00fcrcistan Y\u00f6netimi, Abhazya ile siyasi diyalog kurmak yerine, 14 A\u011fustos 1992&#8217;de Abhazya&#8217;ya silahl\u0131 sald\u0131r\u0131 ba\u015flatarak g\u00fc\u00e7 kullanmay\u0131 se\u00e7ti.<\/p>\n<p>&nbsp;<\/p>\n<p>Askeri faaliyetlerin bitmesinden sonra Abhazya ve G\u00fcrcistan BM&#8217;in ve Rusya Federasyonu&#8217;nun arabuluculu\u011fu ve AG\u0130T&#8217;in kat\u0131l\u0131m\u0131 ile g\u00f6r\u00fc\u015fmelere ba\u015flad\u0131lar; en ba\u015fta gelen sorunlardan biri bundan sonraki kar\u015f\u0131l\u0131kl\u0131 ili\u015fkiler konusuydu. Bu g\u00f6r\u00fc\u015fmeler sonucunda 4 Nisan 1994&#8217;te imzaland\u0131. Bildiri, Abhazya ve G\u00fcrcistan aras\u0131nda &#8220;G\u00fcrcistan-Abhazya Anla\u015fmazl\u0131\u011f\u0131n\u0131n Siyasi \u00c7\u00f6z\u00fcm\u00fc \u0130\u00e7in \u00d6nlemler Deklarasyonu &#8221; devlet-hukuk ili\u015fkisi olmad\u0131\u011f\u0131n\u0131 tespit ediyordu.<\/p>\n<p>&nbsp;<\/p>\n<p>Bu hukuki de\u011ferlendirme BM Genel Sekreteri&#8217;nin 3 May\u0131s 1994 tarihli-529 say\u0131l\u0131 raporunda ve &#8220;G\u00fcrcistan-Abhazya anla\u015fmazl\u0131\u011f\u0131n\u0131n her y\u00f6n\u00fcyle \u00e7\u00f6z\u00fcm\u00fcn\u00fcn siyasi ve hukuki unsurlar\u0131na y\u00f6nelik teklifler&#8221;de de yap\u0131l\u0131yordu.<\/p>\n<p>&nbsp;<\/p>\n<p>Bu belgelerde deniyor ki: &#8220;Abhazya, tart\u0131\u015fmal\u0131 konular\u0131n \u00e7\u00f6z\u00fcm\u00fcnden sonra g\u00f6r\u00fc\u015fmeler sonucunda kurulacak birlik devletin b\u00fcnyesinde egemenlik hakk\u0131na sahip bir \u00f6zne olacakt\u0131r. Birlik devletin ad\u0131 taraflarca bundan sonraki g\u00f6r\u00fc\u015fmelerde belirlenecektir. Taraflar, 21 Aral\u0131k 1991&#8217;deki durumuna g\u00f6re, eski G\u00fcrcistan SSC s\u0131n\u0131rlar\u0131yla kurulacak devletin toprak b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc tan\u0131yacaklard\u0131r.&#8221;<\/p>\n<p>&nbsp;<\/p>\n<p>Bu \u015fekilde, BM Abhazya ve G\u00fcrcistan&#8217;a yeni bir birlik devleti kurmalar\u0131n\u0131 ve daha sonra ad\u0131 \u00fczerinde anla\u015fmalar\u0131n\u0131 \u00f6neriyordu.Ayr\u0131ca, Abhazya Y\u00f6netimi&#8217;nin iste\u011fi ile uluslararas\u0131 h\u00fck\u00fcmet d\u0131\u015f\u0131 &#8220;\u0130\u015fbirli\u011fi \u0130\u00e7in Hukuk\u00e7ular Dostluk Birli\u011fi&#8221; taraf\u0131ndan 4 Nisan bildirisinin ba\u011f\u0131ms\u0131z hukuki ekspertizi yap\u0131ld\u0131. Bu \u00f6rg\u00fct taraf\u0131ndan haz\u0131rlanan raporda, 4 Nisan bildirisinin taraflar aras\u0131nda devlet-hukuk ili\u015fkisinin olmad\u0131\u011f\u0131n\u0131 tespit etti\u011fi belirtiliyor.<\/p>\n<p>&nbsp;<\/p>\n<p>Raporda keza deniyor ki: &#8220;Bildiri metninde g\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, taraflar d\u0131\u015f politika, s\u0131n\u0131r ve g\u00fcmr\u00fck rejimi, enerji, ula\u015f\u0131m, haberle\u015fme, \u00e7evre, insan haklar\u0131 alanlar\u0131nda ortak faaliyet konusunda anla\u015fmaya varm\u0131\u015flard\u0131r. Devlet faaliyetlerinin bu alanlar\u0131 sadece egemen devlete mahsustur.
