Ad\u0131 Abhazya Cumhuriyeti ve Apsn\u0131&#8217;d\u0131r. E\u015fit anlamdad\u0131r.<\/p>\n<p><strong>Madde 2:<\/strong> Halk iradesi y\u00f6netimi genel h\u00fck\u00fcmet y\u00f6netimi Abhazya Cumhuriyeti sistemidir.<\/p>\n<p>Abhazya Cumhuriyeti \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc tek kaynaktan al\u0131r. Bu da halkt\u0131r. Abhazya Cumhuriyeti vatanda\u015flar\u0131d\u0131r.<\/p>\n<p>Halk kendi y\u00f6netimini kendisi ya da se\u00e7ece\u011fi vekili temsil eder.<\/p>\n<p><strong>Madde 3:<\/strong> Abhazya Cumhuriyeti uluslar aras\u0131 hukuklar kural\u0131na uyar. Di\u011fer \u00fclkelerle de anla\u015fmalar bu kurallar \u00e7er\u00e7evesinde yap\u0131l\u0131r.<\/p>\n<p><strong>Madde 4:<\/strong> Abhazya Cumhuriyeti tarihi topraklar\u0131ndan Sadz, Bz\u0131p, Guma, Dal-Tsabal, Abjua, Sam\u0131rzakan(Gagra, Gudauta,Suhum, Gulrip\u015f, O\u00e7am\u00e7ira, Tkuar\u00e7al, Gal) ve kentleri (Gagra, Gudauta,Suhum, Gulrip\u015f, O\u00e7am\u00e7ira, Tkuar\u00e7al, Gal) Abhazya Cumhuriyeti ile bir b\u00fct\u00fcnd\u00fcr, par\u00e7alanamaz, b\u00f6l\u00fcnemez.<\/p>\n<p><strong>Madde 5:<\/strong> Topraklar ve di\u011fer do\u011fal rezervler halk\u0131n mal\u0131d\u0131r. Bu da Abhazya Cumhuriyeti\u2019nce korunur ve kullan\u0131l\u0131r. Do\u011fal rezervlerin kullan\u0131lmas\u0131 Abhazya Cumhuriyeti yasalar\u0131na g\u00f6re ger\u00e7ekle\u015fir.<\/p>\n<p><strong>Madde 6:<\/strong> Abhazya Cumhuriyeti\u2019nin resmi dili Abhazca\u2019d\u0131r. Rus\u00e7a ise Abhazya\u2019da sonra yine devlet dili olarak kabul edilmi\u015ftir.<\/p>\n<p>Devlet tam etnik gruplar (Abhazya\u2019da ya\u015fayan) kendi ana dillerini \u00f6zg\u00fcr bir bi\u00e7imde kullan\u0131lmas\u0131na izin vermi\u015ftir.<\/p>\n<p><strong>Madde 7:<\/strong> Abhazya Cumhuriyeti h\u00fck\u00fcmeti yasama, y\u00fcr\u00fctme ve yarg\u0131 kurumlar\u0131ndan olu\u015fur ve m\u00fcdahale edilmez<\/p>\n<p><strong>Madde 8:<\/strong> Abhazya Cumhuriyeti il, kasaba, k\u00f6ylerinde se\u00e7im olur. \u0130l, il\u00e7e, k\u00f6y y\u00f6neticilerini halk se\u00e7er, se\u00e7ilen ki\u015fi yard\u0131mc\u0131s\u0131n\u0131 kendi belirler, h\u00fck\u00fcmet organlar\u0131 sisteminde \u00e7al\u0131\u015f\u0131rlar.<\/p>\n<p><strong>Madde 9:<\/strong> Varolan anayasan\u0131n b\u00fcy\u00fck bir hukuk g\u00fcc\u00fc vard\u0131r. Yasama ve hukuk kurallar\u0131 anayasaya uygun olarak haz\u0131rlan\u0131r.<\/p>\n<p><strong>Madde 10:<\/strong> Abhazya Cumhuriyeti\u2019nin kendi bayra\u011f\u0131, sanca\u011f\u0131 ve ulusal mar\u015f\u0131 vard\u0131r.<\/p>\n<p>Abhazya\u2019n\u0131n ba\u015fkenti Suhum\u2019dur (Akua\u2019d\u0131r).<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li><strong> B\u00d6L\u00dcM<\/strong><\/li>\n<\/ol>\n<p><strong>Vatanda\u015fl\u0131k, \u0130nsan Haklar\u0131 ve \u00d6zg\u00fcrl\u00fckleri<\/strong><\/p>\n<p><strong>Madde 11:<\/strong> Abhazya Cumhuriyet t\u00fcm insan haklar\u0131 deklarasyonuna uymay\u0131 taahh\u00fct eder ve insan haklar\u0131 ve \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc garanti eder. Uluslararas\u0131 ekonomik, sosyal k\u00fclt\u00fcrel haklarda vatanda\u015fl\u0131k, politik haklar ve bunlar\u0131n yan\u0131 s\u0131ra t\u00fcm di\u011fer devletlerce tan\u0131nan uluslar aras\u0131 s\u00f6zle\u015fmeleri tan\u0131r.<\/p>\n<p><strong>Madde 12:<\/strong> \u0130nsan t\u00fcm haklara do\u011fdu\u011fu andan ba\u015flayarak sahip olur. Her insan \u00f6zg\u00fcr olarak do\u011far ve t\u00fcm yurtta\u015flar kanun ve mahkeme \u00f6n\u00fcnde dini, dili \u0131rk\u0131, milliyeti ve g\u00f6revi oturdu\u011fu yeri, ideolojisi ve daha ne olursa olsun e\u015fittir.<\/p>\n<p><strong>Madde 13:<\/strong> \u0130nsan haklar\u0131 ve \u00f6zg\u00fcrl\u00fckleri \u015f\u00f6yledir; ya\u015fama hakk\u0131, \u00f6zg\u00fcrl\u00fck, dokunulmazl\u0131k, \u00f6zel ya\u015fam\u0131d\u0131r.<\/p>\n<p><strong>Madde 14:<\/strong> Her insan\u0131n \u00f6zel ya\u015fant\u0131s\u0131n\u0131 \u00f6zg\u00fcrce kurar, ki\u015fisel ve aile s\u0131rlar\u0131n\u0131 koruma hakk\u0131na yarg\u0131n\u0131n ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131, dinini, g\u00fcnl\u00fck ya\u015fam\u0131n\u0131, d\u00fc\u015f\u00fcnce, konu\u015fma ve yayma hakk\u0131na sahiptir.<\/p>\n<p><strong>Madde 15:<\/strong> Hi\u00e7 kimse ba\u015fkas\u0131na sert davranarak ya da k\u00fc\u00e7\u00fck d\u00fc\u015f\u00fcrerek kar\u015f\u0131s\u0131ndakini ve kar\u015f\u0131s\u0131ndakilerin insani de\u011ferlerini hi\u00e7e sayarak cezaland\u0131ramaz.<\/p>\n<p><strong>Madde 16: <\/strong> Her insan \u201c\u00f6zg\u00fcrl\u00fck hakk\u0131n\u0131 kullanmak suretiyle bulundu\u011fu b\u00f6lgede se\u00e7me ve se\u00e7ilme hakk\u0131, gizli oy kullanma ve di\u011fer haklara sahiptir.<\/p>\n<p><strong>Madde 17:<\/strong> Her insan\u0131n birle\u015fme, bar\u0131\u015f mitingleri, toplant\u0131lar, eylem ve grev hakk\u0131na sahiptir.<\/p>\n<p><strong>Madde 18:<\/strong> Anayasaya oylar\u0131 faaliyet g\u00f6steren ya da g\u00f6stermeye \u00e7al\u0131\u015fan dernekler, partiler, organizasyonlar, anayasay\u0131 zorla de\u011fi\u015ftirmeye \u00e7al\u0131\u015fanlar, devletin kimli\u011fi ve b\u00fct\u00fcnl\u00fcne g\u00f6lge d\u00fc\u015f\u00fcrecek silahl\u0131 guruplar olu\u015fturan silahl\u0131 guruplar sosyal, nasyonal ve dini guruplar\u0131n faaliyetleri b\u00f6lgede kesin olarak yasaklanm\u0131\u015ft\u0131r.<\/p>\n<p><strong>Madde 19:<\/strong> Her insan ekonomik \u00f6zg\u00fcrl\u00fck, eme\u011finin \u00f6zg\u00fcrl\u00fc\u011f\u00fc ya\u015fant\u0131 yeri, e\u011fitim, \u00f6\u011fretim, tatil, sa\u011fl\u0131k hizmetleri ve sosyal d\u00fczenini kurma ya da yararlanma hakk\u0131na sahiptir.<\/p>\n<p><strong>Madde 20:<\/strong> Ki\u015fi ya\u015fad\u0131\u011f\u0131 evin sahibidir. Kimse nas\u0131l ya\u015fad\u0131\u011f\u0131na kar\u0131\u015famaz (Abhazya Cumhuriyeti yasalar\u0131 \u00e7er\u00e7evesinde).<\/p>\n<p><strong>Madde 21:<\/strong> Devlet her insan\u0131n hukuksal olarak korunmas\u0131 \u00f6zg\u00fcrl\u00fck ve haklar\u0131n\u0131 garanti eder.<\/p>\n<p><strong>Madde 22:<\/strong> Abhazya Cumhuriyeti yarg\u0131 prensiplerinde su\u00e7u i\u015fleyenin su\u00e7u kan\u0131tlanana dek san\u0131k konumundad\u0131r. Mahkeme karar\u0131 sonras\u0131nda san\u0131k \u201csu\u00e7lu\u201d olur. Bu y\u00fczden san\u0131k su\u00e7suzlu\u011funu kan\u0131tlamak zorunda de\u011fildir. Zaten bu yasal \u00e7er\u00e7eve ile s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><strong>Madde 23: <\/strong> Her tutuklama olay\u0131nda ilk andan ba\u015flayarak avukat tutma ve ifadeyi avukat kontrol\u00fcnde verme hakk\u0131na sahiptir.<\/p>\n<p><strong>Madde 24:<\/strong>\u00a0 Mahkemenin kesin karar\u0131 hi\u00e7 bir \u015fekilde bozulamaz.<\/p>\n<p><strong>Madde 25:<\/strong>\u00a0 Yasa, haz\u0131rlanmas\u0131n\u0131n ve sorumlulu\u011funun geri g\u00fcc\u00fc yoktur.<\/p>\n<p><strong>Madde 26:<\/strong> Abhazya Cumhuriyeti yurtta\u015f\u0131\u00a0 herkese devlet taraf\u0131ndan yap\u0131lan yanl\u0131\u015f uygulamalar\u0131 herhangi bir yasad\u0131\u015f\u0131 i\u015fe kar\u0131\u015fan devlet organlar\u0131n\u0131 deliller g\u00f6stererek ele\u015ftirme hakk\u0131na sahiptir.<\/p>\n<p><strong>Madde 27:<\/strong> Abhazya Cumhuriyeti yurtta\u015flar\u0131n\u0131n yurtta\u015fl\u0131k haklar\u0131 elinden al\u0131namaz. Abhazya Cumhuriyeti kendi yurtta\u015flar\u0131n\u0131 koruma garantisi verir.<\/p>\n<p><strong>Madde 28:<\/strong> Abhazya Cumhuriyeti yurtta\u015f\u0131 e\u015fittir.<\/p>\n<p><strong>Madde 29:<\/strong> Abhazya Cumhuriyeti yurtta\u015flar\u0131n\u0131 yasalar \u00e7er\u00e7evesinde vergisini vermek zorundad\u0131r.<\/p>\n<p><strong>Madde 30:<\/strong> Abhazya Cumhuriyeti i\u00e7erisinde bulunan her insan Abhazya Cumhuriyeti anayasas\u0131 ve yasalar\u0131na uymak zorundad\u0131r.<\/p>\n<p><strong>Madde 31:<\/strong> Abhazya Cumhuriyeti\u2019nde bulunan her insan di\u011fer insanlar\u0131n \u00f6zg\u00fcrl\u00fcklerine uymak zorundad\u0131r.<\/p>\n<p><strong>Madde 32:<\/strong> Abhazya Cumhuriyeti i\u00e7erisinde bulunan her insan \u00e7evresindekilere sayg\u0131 g\u00f6stermek zorundad\u0131r.<\/p>\n<p><strong>Madde 33:<\/strong> Yurtta\u015f\u0131n korunmas\u0131 her Abhazya Cumhuriyeti yurtta\u015f\u0131n\u0131n borcu ve g\u00f6revidir.<\/p>\n<p><strong>Madde 34:<\/strong> Abhazya Cumhuriyeti anayasas\u0131ndan say\u0131lan haklar\u0131 b\u00fct\u00fcn d\u00fcnyada kabul edilen insan haklar\u0131n\u0131 da kapsar<\/p>\n<p><strong>Madde 35:<\/strong> Abhazya Cumhuriyeti insan haklar\u0131na ve \u00f6zg\u00fcrl\u00fcklerine ayk\u0131r\u0131 yasalar\u0131 kabul edemez. Di\u011fer s\u0131n\u0131rl\u0131 haklar ve \u00f6zg\u00fcrl\u00fckler yaln\u0131z anayasal hukuka ayk\u0131r\u0131 olmas\u0131 durumunda g\u00fcvenli\u011fin ve toplumun d\u00fczeni, sa\u011fl\u0131\u011f\u0131n korunmas\u0131, zararl\u0131l\u0131k ola\u011fan \u00fcst\u00fc durum ve sava\u015flarda g\u00f6sterilmez<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><strong> B\u00d6L\u00dcM<\/strong><\/li>\n<\/ol>\n<p><strong>Yarg\u0131\u00a0<\/strong><\/p>\n<p><strong>Madde 36:<\/strong> T\u00fcm yarg\u0131 i\u015fleri Abhazya Cumhuriyeti anayasas\u0131nda yer almakta olup parlamento taraf\u0131ndan d\u00fczenlenir.<\/p>\n<p><strong>Madde 37:<\/strong> Abhazya parlamentosu 35 milletvekilinden olu\u015fur. Parlamento se\u00e7imle ba\u015fa gelir. Se\u00e7imde herkes e\u015fit haklara sahiptir. Se\u00e7im gizli oyla yap\u0131l\u0131r. Parlamento \u00fcyesinin g\u00f6rev s\u00fcresi 5 y\u0131ld\u0131r.<\/p>\n<p><strong>Madde 38:<\/strong> Abhazya Cumhuriyeti parlamentosunda 25 ya\u015f\u0131n\u0131 dolduran ve se\u00e7ilme yasalar\u0131na uyan\u00a0 her Abhazya Cumhuriyeti yurtta\u015f\u0131 girebilir. Abhazya Cumhuriyeti\u00a0 ba\u015fkanl\u0131\u011f\u0131 g\u00f6revini y\u00fcr\u00fcten ki\u015fi bakanlar, kabinesi \u00fcyeleri ve yarg\u0131 organ\u0131ndaki g\u00f6revliler, \u00fccret al\u0131rlar ve milletvekilli\u011fi d\u0131\u015f\u0131nda bir i\u015fle u\u011fra\u015famazlar. Yaln\u0131z \u00f6\u011fretim g\u00f6revlisi, bilim adam\u0131 olarak \u00e7al\u0131\u015fanlar\u0131 kapsamaz. Parlamentoda g\u00f6revli milletvekilleri \u00fccretlerini Abhazya Cumhuriyeti\u2019nden al\u0131r.<\/p>\n<p><strong>Madde 39:<\/strong> Abhazya Cumhuriyeti milletvekilleri g\u00f6rev s\u00fcreleri i\u00e7erisinde dokunulmazl\u0131k haklar\u0131na sahiptirler, yakalanamaz, tutuklanamaz, haklar\u0131nda soru\u015fturma a\u00e7\u0131lamaz. Yaln\u0131z olay yerinde su\u00e7u i\u015flerken yakalanmad\u0131\u011f\u0131 durumlarda, \u00f6zel ya\u015fam\u0131 incelemeye al\u0131namaz. Bu da yaln\u0131z di\u011fer insanlar\u0131n haklar\u0131n\u0131 tehlikeye atm\u0131yorsa. Dokunulmazl\u0131k haklar\u0131 parlamento taraf\u0131ndan al\u0131nan kararla al\u0131n\u0131r yada verilir.<\/p>\n<p><strong>Madde 40:<\/strong> Parlamenterler ba\u015fka devletin korumas\u0131n\u0131 isteyemezler.<\/p>\n<p><strong>Madde 41:<\/strong> Parlamento ilk toplant\u0131s\u0131nda se\u00e7im hakk\u0131nda bilgilendirilir.<\/p>\n<p><strong>Madde 42:<\/strong> Parlamento kendi t\u00fcz\u00fc\u011f\u00fcne g\u00f6re s\u00f6zc\u00fc, s\u00f6zc\u00fc yard\u0131mc\u0131s\u0131 ve di\u011fer g\u00f6revli komisyon ve komiteleri se\u00e7er, y\u00f6nlendirir ve gerekli t\u00fcm enformasyonlar\u0131 parlamentoya iletir. Parlamentoda al\u0131nan kararlar\u0131 imzalar. Parlamento s\u00f6zc\u00fcs\u00fc se\u00e7ilene dek ilk toplant\u0131da parlamentoya en ya\u015fl\u0131 parlamenter se\u00e7ilir.<\/p>\n<p><strong>Madde 43:<\/strong>\u00a0 Parlamento g\u00f6r\u00fc\u015fmeleri y\u0131lda iki kez \u00f6zel kararlar i\u00e7in toplan\u0131r.<\/p>\n<p><strong>Madde 44:<\/strong> Parlamentoda al\u0131nan her karar y\u00fcr\u00fcrl\u00fc\u011fe girer. Yaln\u0131z anayasaya ayk\u0131r\u0131 oldu\u011fu zaman ya da \u00fc\u00e7te iki \u00e7o\u011funluk sa\u011flanamazsa kabul edilemez.<\/p>\n<p><strong>Madde 45:<\/strong> Abhazya Cumhuriyeti parlamentosunca kabul edilen her yasa tasla\u011f\u0131 devlet ba\u015fkan\u0131na sunulur. E\u011fer devlet ba\u015fkan\u0131 bu karara imza atarsa 15 g\u00fcn i\u00e7inde y\u00fcr\u00fcrl\u00fc\u011fe girer. Yasa tasar\u0131s\u0131 y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi andan ba\u015flayarak uygulan\u0131r. Ancak ba\u015fka bir yasayla s\u0131n\u0131rland\u0131r\u0131lana dek. Tasar\u0131 devlet ba\u015fkan\u0131 taraf\u0131ndan imzalanmad\u0131\u011f\u0131 zaman parlamentoya geri d\u00f6ner. E\u011fer parlamento ikinci bir kez yasa tasar\u0131s\u0131n\u0131 devlet ba\u015fkan\u0131na g\u00f6nderirse parlamentoda \u00e7o\u011funluk bu karar\u0131 ald\u0131\u011f\u0131 i\u00e7in devlet ba\u015fkan\u0131 bunu imzalamak ve y\u00fcr\u00fcrl\u00fc\u011fe sokmak zorundad\u0131r.<\/p>\n<p>E\u011fer yasa tasar\u0131s\u0131 devlet ba\u015fkan\u0131 taraf\u0131ndan geri \u00e7evrilmemi\u015f ise kendisine sunuldu\u011fu g\u00fcnden ba\u015flayarak 10 g\u00fcn i\u00e7erisinde kendi imzalamazsa da yasa y\u00fcr\u00fcrl\u00fc\u011fe girer.<\/p>\n<p><strong>Madde 46:<\/strong> Yarg\u0131 haklar\u0131 inisiyatifi Abhazya Cumhuriyeti parlamentosundad\u0131r. Abhazya Cumhuriyeti devlet ba\u015fkan\u0131 ad\u0131yla birlikte sunulur. Devlet ba\u015fkan\u0131 yard\u0131mc\u0131s\u0131 olmak i\u00e7in 35 ya\u015f\u0131ndan k\u00fc\u00e7\u00fck, 65 ya\u015f\u0131ndan b\u00fcy\u00fck ve se\u00e7im kanunlar\u0131na uygun olmak gerekir. Devlet ba\u015fkan\u0131 yard\u0131mc\u0131s\u0131 devlet ba\u015fkan\u0131 gibi parti \u00fcyeli\u011fi yapmaz . parlamento \u00fcyesi de\u011fildir.<\/p>\n<p><strong>Madde 55:<\/strong> Abhazya Cumhuriyeti Devlet Ba\u015fkan\u0131 yard\u0131mc\u0131s\u0131 g\u00f6reve geldi\u011fi andan ba\u015flayarak ayn\u0131 zamanda da devlet ba\u015fkan\u0131 vekilidir.<\/p>\n<p><strong>Madde 56:<\/strong> Abhazya Cumhuriyeti\u2019nde bulunan\u00a0 t\u00fcm devlet kademeleri ve bakanlar kabinesinin ba\u015f\u0131nda devlet ba\u015fkan\u0131 vard\u0131r. Bakanlar kademesinde ba\u015fkan, ba\u015fbakan yard\u0131mc\u0131s\u0131 bakanlar ve di\u011fer h\u00fck\u00fcmet g\u00f6revlilileri yer al\u0131r.<\/p>\n<p><strong>Madde 57:<\/strong> Abhazya Cumhuriyeti, bakanlar kabinesi toplu olarak ya da tek tek istifa etme hakk\u0131na sahiptir. \u0130stifa belgesi\u00a0 devlet ba\u015fkan\u0131na sunulur. Devlet ba\u015fkan\u0131 kabul edip etmemekte h\u00fcrd\u00fcr.<\/p>\n<p><strong>Madde 58:<\/strong> Abhazya Cumhuriyeti Parlamentosu, bakanlar kabinesi \u00fcyelerine g\u00fcvensizli\u011fini sunabilir ve bunu Abhazya Cumhuriyeti Devlet Ba\u015fkanl\u0131\u011f\u0131\u2019na iletir. Son karar devlet ba\u015fkan\u0131n\u0131nd\u0131r. Abhazya Cumhuriyeti bakanlar kabinesi t\u00fcm \u00e7al\u0131\u015fmalar\u0131n\u0131 anayasal yasalar \u00e7er\u00e7evesinde yapar.<\/p>\n<p><strong>Madde 59:<\/strong> Abhazya Cumhuriyeti Ba\u015fkan\u0131 ve temsilcileri anayasay\u0131 de\u011fi\u015ftiremezler bunu yaparken di\u011fer ceza yasas\u0131n\u0131 gerek\u00e7e olarak g\u00f6steremezler.<\/p>\n<p><strong>Madde 60:<\/strong> Abhazya Cumhuriyeti devlet ba\u015fkan\u0131 temsilcisi yasalar \u00e7er\u00e7evesinde al\u0131nan kararlar\u0131 bas\u0131n yoluyla duyurur ve bu duyuru Abhazya Cumhuriyeti\u2019nde yay\u0131mland\u0131\u011f\u0131 andan ba\u015flayarak y\u00fcr\u00fcrl\u00fc\u011fe girer.<\/p>\n<p><strong>Madde 61:<\/strong> Abhazya Cumhuriyeti Devlet Ba\u015fkan\u0131 karar\u0131 Abhazya Cumhuriyeti anayasas\u0131 ve yasalar\u0131nda y\u00fcksek mahkeme kararlar\u0131yla iptal edilebilir.<\/p>\n<p><strong>Madde 62:<\/strong> S\u0131k\u0131 y\u00f6netim s\u00fcresince sava\u015f durumu, sakin durumlarda Abhazya Cumhuriyeti Devlet Ba\u015fkan\u2019\u0131 buna karar verir ve devlet ba\u015fkan\u0131 parlamentoyu bu konuda bilgilendirir.<\/p>\n<p><strong>Madde 63:<\/strong> Devlet Ba\u015fkan\u0131 \u00f6zel ya\u015fam\u0131 dokunulmazl\u0131\u011f\u0131 yasalar taraf\u0131ndan korunur.<\/p>\n<p><strong>Madde 64:<\/strong> Abhazya Cumhuriyeti anayasas\u0131 ve yasalar\u0131n\u0131 devlet ba\u015fkan\u0131 taraf\u0131ndan \u00e7i\u011fnenmesi durumunda g\u00f6revinden al\u0131n\u0131r. Bu karar Abhazya Cumhuriyeti Parlamentosunca al\u0131narak Abhazya Cumhuriyeti Y\u00fcksek Mahkemesi\u2019nde yarg\u0131lan\u0131r ve Abhazya Cumhuriyeti Parlamentosu gizli oylamayla 3 de 2 \u00e7o\u011funlu\u011fu karar al\u0131r.<\/p>\n<p><strong>Madde 65:<\/strong> Abhazya Cumhuriyeti Devlet Ba\u015fkan\u0131 istedi\u011fi zaman istifa edebilir ve istifas\u0131n parlamentoya sunar parlamentoda oy \u00e7o\u011funlu\u011fuyla karar al\u0131r.<\/p>\n<p><strong>Madde 66:<\/strong> Abhazya Cumhuriyeti Devlet Ba\u015fkan\u0131 de\u011fi\u015fik nedenlerle (istifa, g\u00f6revden al\u0131nma ve \u00f6l\u00fcm) durumlar\u0131nda\u00a0 devlet yard\u0131mc\u0131s\u0131 g\u00f6rev al\u0131r. \u0130kisinin de bo\u015falmas\u0131 durumunda g\u00f6revi ba\u015fbakan al\u0131r. Bununda olmamas\u0131 durumunda g\u00f6reve parlamento s\u00f6zc\u00fcs\u00fcne verilir.<\/p>\n<p><strong>Madde 67:<\/strong> Herhangi bir Abhazya Cumhuriyeti Devlet Ba\u015fkan\u0131\u2019n\u0131n g\u00f6revde olmamas\u0131 durumunda bu yukar\u0131da say\u0131lan maddeler se\u00e7ime kadar devlet ba\u015fkanl\u0131\u011f\u0131 g\u00f6revine vekiller yapar. Devlet ba\u015fkanl\u0131\u011f\u0131 se\u00e7imleri 3 ayl\u0131k s\u00fcre i\u00e7inde yap\u0131l\u0131r. Bu s\u0131rada devlet ba\u015fkanl\u0131\u011f\u0131 g\u00f6revini y\u00fcr\u00fcten devlet ba\u015fkan\u0131 vekili referandum yapma hakk\u0131na sahip de\u011fildir ya da Abhazya Cumhuriyeti anayasas\u0131nda de\u011fi\u015fik yapma hakk\u0131na sahip de\u011fildir.<\/p>\n<p>&nbsp;<\/p>\n<p><strong> B\u00d6L\u00dcM 5<\/strong><\/p>\n<p><strong>Yarg\u0131<\/strong><\/p>\n<p><strong>Madde 68:<\/strong> Abhazya Cumhuriyeti yarg\u0131 hakk\u0131 yaln\u0131zca mahkemelerindir. Ticari nedenlerden do\u011fan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fc ticari mahkemelerindir. Abhazya Cumhuriyeti\u2019nde mahkemeler anayasa yasalar\u0131nda belirtildi\u011fi gibidir.<\/p>\n<p><strong>Madde 69:<\/strong> Hakimlik g\u00f6revi Abhazya Cumhuriyeti yurtta\u015f\u0131 27 ya\u015f\u0131n\u0131 doldurmu\u015f hukuk fak\u00fcltesi mezunu, mesle\u011finde en az 5 y\u0131l deneyimi olan hukuk uzmanlar\u0131na verilir. Abhazya Cumhuriyeti y\u00fcksek mahkemesi ba\u015fkan\u0131 ve mahkeme heyeti \u00fcyeleri, ticaret mahkemesi ba\u015fkan\u0131 ve hakimi, Abhazya Cumhuriyeti Devlet Ba\u015fkan\u0131 taraf\u0131ndan Abhazya Cumhuriyeti parlamentosuna \u00f6nerilir.<\/p>\n<p><strong>Madde 70:<\/strong> Mahkeme hakimi olmad\u0131\u011f\u0131 zaman bu g\u00f6revi y\u00fcr\u00fctecek ki\u015finin \u00fccretli olarak devlet kurulu\u015funda \u00e7al\u0131\u015fmas\u0131 gerekir (\u00f6\u011fretim g\u00f6revlisi, bilim adam\u0131 ve toplumsal ve k\u00fclt\u00fcrel faaliyetleri y\u00fcr\u00fcten ki\u015filer d\u0131\u015f\u0131nda) hakimler yasalarla belirlenen s\u00fcreyi doldurdu\u011fu zaman kendi \u00e7al\u0131\u015fmas\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olarak Abhazya Cumhuriyeti\u2019nden maa\u015f al\u0131r.<\/p>\n<p><strong>Madde 71:<\/strong> Hakimlerin dokunulmazl\u0131\u011f\u0131 vard\u0131r. Herkesten ba\u011f\u0131ms\u0131z yaln\u0131z Abhazya Cumhuriyeti anayasas\u0131 ve yasalar\u0131 ile hareket ederler.<\/p>\n<p><strong>Madde 72:<\/strong> Mahkeme, \u00e7al\u0131\u015fmalar\u0131n\u0131 genelde a\u00e7\u0131k olarak, yasalar \u00e7er\u00e7evesinde ger\u00e7ekle\u015ftirir. Yarg\u0131da su\u00e7lu ve su\u00e7layan e\u015fit haklara sahip olarak yarg\u0131 huzuruna \u00e7\u0131karlar.<\/p>\n<p><strong>Madde 73:<\/strong> Abhazya Cumhuriyeti y\u00fcksek yarg\u0131 organ\u0131 y\u00fcksek mahkemedir. T\u00fcm yarg\u0131 faaliyetlerini ara\u015ft\u0131rma, inceleme s\u00fcresini, geni\u015fletme hakk\u0131na sahiptir.<\/li>\n<\/ol>\n<p><strong> Madde 74:<\/strong> Abhazya Cumhuriyeti mahkemelerinin karar verme sorumlulu\u011fu Abhazya Cumhuriyeti ad\u0131nad\u0131r<\/p>\n<p><strong>Madde 75:<\/strong> Mahkeme heyeti yasalar \u00e7er\u00e7evesinde \u00e7al\u0131\u015fmad\u0131\u011f\u0131 zaman herhangi bir su\u00e7 tutuklama vb. gibi durumlarda olaya Abhazya Cumhuriyeti Genel Savc\u0131s\u0131 ve se\u00e7ilen savc\u0131 olay yerinde ara\u015ft\u0131rma yapar. Abhazya Cumhuriyeti savc\u0131l\u0131k organ\u0131 tek bir sistemden olu\u015fur. Devletin di\u011fer organlar\u0131 ba\u011f\u0131ms\u0131z \u00e7al\u0131\u015f\u0131r.<\/p>\n<p><strong>Madde 76:<\/strong> Abhazya Cumhuriyeti genel savc\u0131s\u0131 se\u00e7imi Abhazya Cumhuriyeti parlamentosunca al\u0131nan kararla belirlenir. Bu karar Abhazya Cumhuriyeti Devlet Ba\u015fkan\u0131\u2019na sunulur<\/p>\n<p><strong>Madde 77:<\/strong> Savc\u0131l\u0131k \u00e7al\u0131\u015fmalar\u0131 yasalarla s\u0131n\u0131rl\u0131d\u0131r.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>B\u00d6L\u00dcM 6<\/strong><\/p>\n<p><strong>Yerel Y\u00f6netim<\/strong><\/p>\n<p><strong>Madde 78:<\/strong> Yerel y\u00f6netim kent, kasaba ve di\u011fer yerle\u015fim yerlerinde varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcr\u00fcr.<\/p>\n<p><strong>Madde 79:<\/strong> Yerel y\u00f6netim yap\u0131lan se\u00e7imle i\u015f ba\u015f\u0131na gelen ki\u015filerden olu\u015fur. Abhazya Cumhuriyeti\u2019nde bulunan \u015fehir ve kasabada yerel y\u00f6netimin ba\u015f\u0131 Abhazya Cumhuriyeti Devlet Ba\u015fkan\u0131 atar. Atanan ki\u015fi se\u00e7imle i\u015fba\u015f\u0131na getirilen bu kuruldan birisidir.
