Komite 1991 y\u0131l\u0131nda Anayasa Mahkemesi&#8217;nin kurulmas\u0131yla fesholmu\u015ftur. Bununla birlikte, 1993 y\u0131l\u0131n\u0131n Mart, Eyl\u00fcl, Ekim aylar\u0131nda meydana gelen olaylar, Anayasa Mahkemesi&#8217;nin siyasi g\u00fc\u00e7ler aras\u0131nda ortaya \u00e7\u0131kan gerilimlerin giderilmesinde duruma m\u00fcdahil olmas\u0131 ve Cumhurba\u015fkan\u0131<br \/>\nile Rusya Y\u00fcksek Sovyet (Daimi Yasama Organ\u0131) aras\u0131nda ya\u015fanan \u00e7at\u0131\u015fman\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in kendi inisiyatifi ile giri\u015fimde bulunmas\u0131 ve bunun ba\u015far\u0131s\u0131zl\u0131kla sonu\u00e7lanmas\u0131n\u0131n ard\u0131ndan Anayasa Mahkemesi&#8217;nin g\u00f6revini yapmas\u0131 durdurulmu\u015ftur. Anayasa Mahkemesi&#8217;nin 1993 y\u0131l\u0131nda politize olmas\u0131na bir reaksiyon olarak 1994 y\u0131l\u0131nda haz\u0131rlanan ve 1995 y\u0131l\u0131ndan itibaren uygulanmaya ba\u015flanan Anayasa Mahkemesi Kanunu Anayasa Mahkemesi&#8217;nin g\u00f6revlerinde k\u0131s\u0131tlamalar \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr.<\/p>\n<p>Bu ba\u011flamda Anayasa Mahkemesi&#8217;nin g\u00f6rev ve yetkisi gelecekte siyasalla\u015fmas\u0131na ihtimaline kar\u015f\u0131l\u0131k k\u0131s\u0131tlanm\u0131\u015f, \u00fcye say\u0131s\u0131 artt\u0131r\u0131lm\u0131\u015f ve salt \u00e7o\u011funlukla karar verebilmesi sa\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>Buna ilave olarak 1991-1993 y\u0131llar\u0131 aras\u0131nda elde edilen tecr\u00fcbelerden hareket edilerek kurulu\u015f yap\u0131s\u0131nda \u00f6nemli de\u011fi\u015fiklikler yap\u0131lm\u0131\u015ft\u0131r. Bunlardan en \u00f6nemlileri; \u00fcye say\u0131s\u0131n\u0131n 19\u2019a \u00e7\u0131kar\u0131lmas\u0131; \u00fcyelik s\u00fcresinin 12 y\u0131l, emeklilik ya\u015f\u0131n\u0131n 70 olmas\u0131, mahkemenin iki heyet halinde \u00e7al\u0131\u015fmas\u0131; mahkemenin kurumsal, mali ve personel sorunlar\u0131n\u0131 \u00e7\u00f6zmesi noktas\u0131nda eskisine oranla daha ba\u011f\u0131ms\u0131z olmas\u0131d\u0131r. Bunlar\u0131n yan\u0131nda ba\u015fkan, ba\u015fkanvekili ve \u00fcye-sekreterin yetkilerinde k\u0131s\u0131tlamalara gidilerek<br \/>\n\u00fcyeler aras\u0131ndaki e\u015fitlik ilkesinin \u00f6nemi vurgulanm\u0131\u015ft\u0131r.<\/p>\n<p>1993 y\u0131l\u0131nda ya\u015fanan olaylarda Anayasa Mahkemesi&#8217;nin rol\u00fc k\u0131saca a\u015fa\u011f\u0131daki gibi olmu\u015ftur. 1992 y\u0131l\u0131nda ba\u015flayan Yeltsin&#8217;in reform program\u0131 nedeniyle ortaya \u00e7\u0131kan hiper enflasyon ve a\u011f\u0131r vergiler Yeltsin&#8217;in politikalar\u0131na kar\u015f\u0131l\u0131k bir direni\u015f hareketi ba\u015flatt\u0131. 20 Mart 1993&#8217;de Yeltsin &#8220;\u00f6zel rejim&#8221; kararnamesi haz\u0131rlayarak yeni yasama se\u00e7imlerinin<br \/>\nzamanlamas\u0131 ve yeni anayasa konusunda yap\u0131lacak referandum sonu\u00e7lar\u0131na kadar ola\u011fan\u00fcst\u00fc y\u00fcr\u00fctme yetkilerine sahip oldu\u011funu ilan etti. Yeltsin kar\u015f\u0131t\u0131 olan Ba\u015fkan Yard\u0131mc\u0131s\u0131 Rutskoy, Yeltsin&#8217;in yetkilerini geni\u015fletmesini ele\u015ftirdi. Anayasa Mahkemesi Yeltsin&#8217;in Anayasa&#8217;ya<br \/>\nayk\u0131r\u0131 olarak hareket etti\u011fine karar verdi. Bunun \u00fczerinde Anayasaya ayk\u0131r\u0131 olmayacak yeni bir kararname haz\u0131rland\u0131.<\/p>\n<p>Parlamento yap\u0131lacak olan referandumun kural\u0131n\u0131 de\u011fi\u015ftirerek Yeltsin&#8217;in ma\u011flup olmas\u0131n\u0131 istedi. Buna g\u00f6re referandumda vatanda\u015flar\u0131n Yeltsin&#8217;in reformlar\u0131n\u0131 benimseyip benimsemedikleri ve daha \u00f6nceki ba\u015fkanl\u0131k ve yasama se\u00e7imlerini destekleyip desteklemedikleri sorulacakt\u0131. Bununla birlikte parlamento Yeltsin&#8217;in kazanabilmesi i\u00e7in se\u00e7imlere kat\u0131lanlar\u0131n de\u011fil, toplam se\u00e7men say\u0131s\u0131n\u0131n %50&#8217;sinden fazlas\u0131n\u0131n oyunun al\u0131nmas\u0131n\u0131n gerekli oldu\u011funu s\u00f6yledi. Sorun Anayasa Mahkemesi&#8217;nin \u00f6n\u00fcne geldi\u011finde bu kez Anayasa Mahkemesi Yeltsin&#8217;in yan\u0131nda durarak ba\u015fkan\u0131n yaln\u0131zca iki konuda salt \u00e7o\u011funlu\u011fa ihtiyac\u0131 oldu\u011funa karar verdi. Bunlardan birincisi kendisine olan deste\u011fin belirlenmesi, ikincisi ise, yeni ba\u015fkanl\u0131k ve parlamento se\u00e7imlerinin yap\u0131lmas\u0131 konusunda. Bu d\u00f6nemde Anayasa Mahkemesi&#8217;ne intikal eden bir ba\u015fka olay Yeltsin&#8217;in Rutskoy&#8217;un yetkilerini ask\u0131ya almas\u0131 oldu. Y\u00fcksek Sovyet (Yasama Organ\u0131) buna itiraz ederek Anayasa Mahkemesi&#8217;ne ba\u015fvurdu. Buna ilave olarak, Yeltsin&#8217;in Parlamento&#8217;yu Anayasa&#8217;ya ayk\u0131r\u0131 olarak fesh etmesi \u00fczerine konuyu inceleyen Anayasa Mahkemesi, Yeltsin&#8217;in Anayasa&#8217;ya ayk\u0131r\u0131 davrand\u0131\u011f\u0131 bu<br \/>\nnedenle ba\u015fkanl\u0131k g\u00f6revinden azledilebilece\u011fine karar vermi\u015ftir.<\/p>\n<p>Bunlar\u0131n yan\u0131nda mahkemenin yetkisinde de a\u015fa\u011f\u0131da say\u0131lan de\u011fi\u015fiklikler<br \/>\nolmu\u015ftur. \u0130lk olarak, daha \u00f6nceki yasan\u0131n aksine mahkeme kendi inisiyatifi ile karar vermesinin yolu kapat\u0131lm\u0131\u015ft\u0131r. \u00d6nceki yasada ba\u015fkan ve di\u011fer y\u00fcksek devlet g\u00f6revlilerinin karar ve eylemlerinin anayasall\u0131\u011f\u0131na ili\u015fkin olarak dan\u0131\u015fma g\u00f6r\u00fc\u015f\u00fc (obiter dictum) verme yetkisi kald\u0131r\u0131lm\u0131\u015ft\u0131r. \u0130kinci olarak, hukukun uygulanmas\u0131n\u0131n de\u011ferlendirilmesi Anayasa Mahkemesi&#8217;nin yetkisi olmaktan \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Anayasa Mahkemesi sadece uygulanmakta olan bir yasa h\u00fckm\u00fcne atfedilen anlam\u0131 ortaya \u00e7\u0131karmakla g\u00f6revlendirilmi\u015ftir.<\/p>\n<p>1994 de\u011fi\u015fikli\u011fi ile birlikte Anayasa Mahkemesi yeni yetkiler elde etmi\u015ftir. \u0130lk olarak, anayasan\u0131n resmi ve soyut yorumunu yapma g\u00f6revi verilmi\u015ftir. Bu yetki kuvvetler ayr\u0131l\u0131\u011f\u0131 sisteminde Anayasa Mahkemesinin \u00f6nemini artt\u0131ran bir yetkidir.<\/p>\n<p>\u0130kinci olarak, Mahkemeye federal organlar ve devlet organlar\u0131 aras\u0131ndaki yetki sorunlar\u0131n\u0131 \u00e7\u00f6zme yetkisi verilmi\u015ftir.<\/p>\n<p>Uygulamada ya\u015fanan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fc amac\u0131yla 2001-2005 y\u0131llar\u0131 aras\u0131nda Anayasa Mahkemesi Kanununda baz\u0131 de\u011fi\u015fiklikler yap\u0131lm\u0131\u015ft\u0131r. \u00d6rne\u011fin, ilk olarak, \u00fcyelerin 12 y\u0131ll\u0131k g\u00f6rev s\u00fcresi kald\u0131r\u0131larak T\u00fcrkiye\u2019de oldu\u011fu gibi \u00fcst ya\u015f limiti (70 ya\u015f) esas\u0131 benimsenmi\u015ftir. \u0130kinci olarak, Hakimlerin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 g\u00fc\u00e7lendirilmi\u015f; g\u00f6revlerinin durdurulmas\u0131 ve sona erdirilmesi esaslar\u0131 de\u011fi\u015ftirilmi\u015ftir. \u00dc\u00e7\u00fcnc\u00fc olarak, Anayasa Mahkemesi&#8217;nin baz\u0131 davalar\u0131 duru\u015fma yapmaks\u0131z\u0131n sonu\u00e7land\u0131rmas\u0131n\u0131n yolu a\u00e7\u0131lm\u0131\u015ft\u0131r. Daha \u00f6nceki davalarla benzerlik g\u00f6steren veya ayn\u0131 h\u00fckm\u00fcn iptaline ili\u015fkin davalar\u0131n bu yolla daha k\u0131sa s\u00fcrede sonu\u00e7land\u0131r\u0131lmas\u0131n\u0131n yolu a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><b>\u00dcyelik<br \/>\n<\/b><br \/>\nRusya Anayasa Mahkemesi 19 \u00fcyeden olu\u015fmaktad\u0131r. \u00dcyeler, 40 ya\u015f\u0131n\u0131<br \/>\ndoldurmu\u015f ve cumhurba\u015fkan\u0131 taraf\u0131ndan g\u00f6sterilen adaylar aras\u0131ndan Meclis taraf\u0131ndan se\u00e7ilmektedir. Rusya Federayonu Anayasa Mahkemesi \u00fcyeli\u011finin en dikkat \u00e7ekici y\u00f6n\u00fc \u00fcyelerin akademik kimli\u011fidir. Eski 9 \u00fcyeden biri hari\u00e7 (V.I. Olienik) 8\u2019i hukuk profes\u00f6r\u00fcd\u00fcr (V. A. Toumanov, Marat V. Baglai, T. G. Morschakova, N. V. Vitrouk, N.T. Vedernikov, O. I. Tiunov, V.O. Louchin ve E.M. Ametistov) Mevcut Anayasa Mahkemesi&#8217;nin 19 \u00fcyesinden 10\u2019u hukuk profes\u00f6r\u00fc (V. D. Zorkin, V.G. Strekozov, N.S. Bondar, G.A. Gadzhiev, G.A. Zhilin, S.M. Kazanstev, M. I. Kleandrov, L. O. Krasavchikova, S. P. Mavrin, O.S. Khokhryakova ve B. S. Ebzeev), 1\u2019i hukuk do\u00e7entidir (S.M. Kazans). Bir \u00fcye (N.M. Melnikov) hukuk doktoru, di\u011fer \u00fcyelerin tamam\u0131 nitelikli hukuk\u00e7u (merited jurist) unvan\u0131n\u0131 alm\u0131\u015f ve<br \/>\ndoktora yapmakta olan (kandidat of juridical science) hakimlerdir.<\/p>\n<p><b>Ba\u011f\u0131ms\u0131zl\u0131k<br \/>\n<\/b><br \/>\nAnayasa Mahkemesinin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n bir g\u00f6stergesi olarak mali a\u00e7\u0131dan baz\u0131 g\u00fcvenceler getirilmi\u015ftir. \u00d6rne\u011fin, b\u00fct\u00e7ede bir mali y\u0131l i\u00e7erisinde Mahkemeye ayr\u0131lan miktar bir \u00f6nceki y\u0131ldan az olamaz. Mahkemenin b\u00fct\u00e7esi, genel b\u00fct\u00e7e i\u00e7erisinde ayr\u0131 bir kalem olarak g\u00f6sterilmi\u015ftir.<\/p>\n<p>Ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n di\u011fer bir g\u00f6stergesi \u00fcye ve personelin ald\u0131klar\u0131 maa\u015flard\u0131r.<br \/>\nMahkeme Ba\u015fkan\u0131 \u00fclkede en y\u00fcksek maa\u015f alan (Meclis Ba\u015fkanlar\u0131 ve Ba\u015fbakandan sonra) \u00fc\u00e7\u00fcnc\u00fc ki\u015fi durumundad\u0131r. \u00dcyeler ve Genel Sekreter Bakan d\u00fczeyinde maa\u015f almaktad\u0131r. Uluslararas\u0131 \u0130li\u015fkiler B\u00f6l\u00fcm Ba\u015fkan\u0131 Prof. Pyrikov da kendi maa\u015f\u0131n\u0131n bakan maa\u015f\u0131na yak\u0131n oldu\u011funu s\u00f6ylemi\u015ftir. Bakanlar\u0131n bu durumdan tam haberdar olmad\u0131klar\u0131 veya en az\u0131ndan ses \u00e7\u0131karmad\u0131klar\u0131 s\u00f6ylenmektedir.<\/p>\n<p>\u00dcyeler ba\u011f\u0131ms\u0131z olmakla birlikte; bu nitelik kendilerine s\u0131n\u0131rs\u0131z olarak<br \/>\ntan\u0131nmam\u0131\u015ft\u0131r. Anayasa Mahkemesi Kanunun 15. maddesine g\u00f6re, Kanunu Anayasay\u0131 ve Yarg\u0131 Eti\u011fi Kodunu ihlal ederek disiplin su\u00e7u i\u015fleyen bir \u00fcyenin g\u00f6revi sona erdirilebilece\u011fi gibi kendisine k\u0131nama cezas\u0131 da verilebilir.<\/p>\n<p>Hakimlik mesle\u011finin onur ve \u015ferefine ayk\u0131r\u0131 hareket eden, ge\u00e7erli bir neden<br \/>\nolmaks\u0131z\u0131n \u00fcst \u00fcste iki kez oturumlara kat\u0131lmayan veya bir \u00fcyenin yetersiz oldu\u011funun Anayasa Mahkemesi karar\u0131 ile tespiti halinde \u00fcyeli\u011fin sona ermesi dikkat \u00e7ekici noktalard\u0131r.<\/p>\n<p>Rusya Anayasa Mahkemesi ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve verimlili\u011fi sa\u011flama ad\u0131na personel rejimini de kendisi belirlemektedir. Mahkemede \u00fcyeler d\u0131\u015f\u0131ndaki b\u00fct\u00fcn personel (Genel Sekreter dahil) s\u00f6zle\u015fmeli olarak istihdam edilmektedir. Bu nedenle hi\u00e7bir personelin \u00e7al\u0131\u015fma g\u00fcvencesi bulunmamaktad\u0131r.<\/p>\n<p><b>Personel<br \/>\n<\/b><br \/>\nRusya Anayasa Mahkemesi kurumsal olarak d\u00fcnyan\u0131n en b\u00fcy\u00fck Anayasa<br \/>\nMahkemesidir. Mahkemede \u00e7al\u0131\u015fan personel say\u0131s\u0131 295 olup, bunlardan 119\u2019u y\u00fcksek e\u011fitim alm\u0131\u015ft\u0131r. Bunlara ilave olarak Mahkeme i\u00e7inde ve d\u0131\u015f\u0131nda sivil giyimli yakla\u015f\u0131k 100 polis memuru g\u00fcvenli\u011fi sa\u011flamaktad\u0131r. Her \u00fcyenin iki yard\u0131mc\u0131s\u0131 bulunmaktad\u0131r.<\/p>\n<p>Bunlardan birisi sekreterlik g\u00f6revini y\u00fcr\u00fctmektedir. Di\u011feri ise \u00fcyenin iste\u011fi \u00fczerine hukuk\u00e7ulardan se\u00e7ilmektedir. Genel Sekreterli\u011fe ba\u011fl\u0131 olarak be\u015f dan\u0131\u015fman \u00e7al\u0131\u015fmaktad\u0131r.<\/p>\n<p>Genel Sekreter mahkemenin yaln\u0131zca \u00f6rg\u00fctsel, ara\u015ft\u0131rma, analitik destek, bilgi ve referanslar gibi mahkemenin \u00e7al\u0131\u015fmas\u0131 i\u00e7in gerekli di\u011fer deste\u011fi sa\u011flamakla sorumlu olup heyetin toplant\u0131lar\u0131na kat\u0131lmaktad\u0131r.
