Millet sistemi; Osmanl\u0131 \u0130mparatorlu\u011fu topraklar\u0131nda ya\u015fayan topluluklar\u0131n din veya mezheplerine g\u00f6re s\u0131n\u0131fland\u0131r\u0131l\u0131p y\u00f6netilmesi anlam\u0131na gelir. II. Mehmet (Fatih Sultan Mehmet) zaman\u0131ndan itibaren uygulanmaya ba\u015flanm\u0131\u015ft\u0131r. (1)<\/p>\n<p>Millet Sistemi bir kompart\u0131man sistemi olup bu sistem i\u00e7erisindeki insanlar kendi dini kompart\u0131man\u0131n\u0131n bir \u00fcyesi olarak en alttan en \u00fcst \u00e7izgiye kadar y\u00fckselme imk\u00e2n\u0131na sahiptir ve bunun i\u00e7in de m\u00fccadele ederler. Yine her kompart\u0131man\u0131n se\u00e7kinlerinin toptan askeri s\u0131n\u0131fa mensup olduklar\u0131 ve kompart\u0131manlar aras\u0131 ge\u00e7i\u015flerin de istenmedi\u011fi bu sistemde, Devlet-i Ali de kompart\u0131manlar aras\u0131 \u00e7\u0131kabilecek olas\u0131 \u00e7at\u0131\u015fmalar\u0131 \u00f6nlemekle g\u00f6revlidir (2).<\/p>\n<p>Devleti olu\u015fturan asli unsurlar, M\u00fcsl\u00fcman tebaa olurken; az\u0131nl\u0131klar\u0131 olu\u015fturan gruplar ise \u201cgayrim\u00fcslim\u201dlerdir. Stat\u00fc olarak gayrim\u00fcslimlere belirlenen stat\u00fc ise; z\u0131mmiliktir. Z\u0131mmi anlam olarak zimmet alt\u0131nda olan demektir. Osmanl\u0131\u2019dan g\u00fcn\u00fcm\u00fcze kadar uzanan tarihsel seyir i\u00e7erisinde bu topraklar \u00fczerinde ya\u015fayan geleneksel az\u0131nl\u0131k gruplar\u0131; Ermeniler, Rum-Ortodokslar ve Yahudilerdir.<\/p>\n<p>Tan\u0131nan haklar ba\u011flam\u0131nda Osmanl\u0131\u2019n\u0131n az\u0131nl\u0131k yakla\u015f\u0131m\u0131n\u0131 irdeledi\u011fimizde ibadet yerlerinin dokunulmazl\u0131\u011f\u0131ndan cemaat aras\u0131ndaki nik\u00e2h, miras vs. meselelere cemaat mahkemelerinin yetkili k\u0131l\u0131nmas\u0131na kadar pek \u00e7ok hakk\u0131n gayrim\u00fcslimlere tan\u0131nm\u0131\u015f oldu\u011funu g\u00f6rmekteyiz. Ayr\u0131ca belirtilmesi gereken bir husus, Osmanl\u0131\u2019da askere gayrim\u00fcslimlerin al\u0131nmamas\u0131d\u0131r. Bunun yerine gayrim\u00fcslimlerin askerlik \u00e7a\u011f\u0131ndaki bireylerinden \u201ccizye\u201d ad\u0131 verilen bir vergi al\u0131nmaktayd\u0131.<\/p>\n<p>Gayrim\u00fcslim tebaay\u0131 do\u011frudan ilgilendiren geli\u015fmelere bakt\u0131\u011f\u0131m\u0131zda, ilk olarak kar\u015f\u0131m\u0131za G\u00fclhane-i Hatt\u0131 H\u00fcmayun, bilinen ad\u0131yla Tanzimat Ferman\u0131(1939) \u00e7\u0131kmaktad\u0131r. Padi\u015fah\u0131n kendi iste\u011fiyle(!) ilk kez \u00e7e\u015fitli haklar tan\u0131ma yoluna gitti\u011fi Tanzimat Ferman\u0131 ile her dinden tebaan\u0131n e\u015fit oldu\u011fu ilkesi benimsenmi\u015ftir. Ayr\u0131ca gayrim\u00fcslimlerin can, mal ve \u0131rz g\u00fcvenli\u011finin sa\u011flanmas\u0131 a\u00e7\u0131s\u0131ndan \u00f6nemli bir geli\u015fmedir.<\/p>\n<p>1856 tarihli Islahat Ferman\u0131 ise Tanzimat Ferman\u0131\u2019nda tan\u0131nan haklardan \u00e7ok daha geni\u015f bir haklar yelpazesini i\u00e7ermektedir. \u0130ki ferman aras\u0131ndaki fark, haklar\u0131n n\u00fcfusun tamam\u0131na ya da belli bir grubuna tan\u0131nmas\u0131 y\u00f6n\u00fcndeki ayr\u0131mdan kaynaklanmaktad\u0131r. Tanzimat Ferman\u0131\u2019nda yer alan haklar t\u00fcm tebaay\u0131 ilgilendirirken; Islahat Ferman\u0131 yaln\u0131zca gayrim\u00fcslim az\u0131nl\u0131klara y\u00f6nelik d\u00fczenlemeler i\u00e7ermi\u015ftir. Ayr\u0131ca gayrim\u00fcslimlere tan\u0131nan stat\u00fcn\u00fcn de\u011fi\u015fmesi ve art\u0131k vatanda\u015f olarak de\u011ferlendirilecek olmalar\u0131 \u00f6nemli bir noktad\u0131r.<\/p>\n<p>Osmanl\u0131 D\u00f6nemi\u2019nde ya\u015fanan bir di\u011fer \u00f6nemli geli\u015fme ise; 1876 tarihli Kanun-i Esasi\u2019 dir. Kanunu-i Esasi Islahat ferman\u0131\u2019n\u0131n bir ad\u0131m \u00f6tesine ge\u00e7erek dini farkl\u0131l\u0131klar\u0131n gayrim\u00fcslim tebaa i\u00e7in sorun olmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7mi\u015ftir. Verginin din fark\u0131 g\u00f6zetilmeksizin al\u0131nacak olmas\u0131 bunun bir tezah\u00fcr\u00fcd\u00fcr.<\/p>\n<p><b>2) Lozan\u2019dan G\u00fcn\u00fcm\u00fcze Az\u0131nl\u0131klar<\/p>\n<p><\/b>24 Temmuz 1923 tarihli Lozan Bar\u0131\u015f Antla\u015fmas\u0131 ile T\u00fcrkiye Cumhuriyeti\u2019nin temelleri at\u0131l\u0131rken, k\u00fcllenen Osmanl\u0131 miras\u0131ndan arda kalan sorunlar da ele al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Antla\u015fman\u0131n I. B\u00f6l\u00fcm\u2019 \u00fcn\u00fcn III. Kesim\u2019inde yer alan maddeler (md. 37- 45) az\u0131nl\u0131klara ili\u015fkin d\u00fczenlemeleri i\u00e7ermektedir. Antla\u015fman\u0131n ilgili b\u00f6l\u00fcm\u00fcndeki h\u00fck\u00fcmlere k\u0131saca de\u011finecek olursak; H\u00fck\u00fcmetin din, dil ve soy ayr\u0131m\u0131 yapmaks\u0131z\u0131n herkesin hayat\u0131n\u0131 ve \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc tam ve eksiksiz olarak korumakla y\u00fck\u00fcml\u00fc oldu\u011fu, ayr\u0131ca herkesin dininin gereklerini serbest\u00e7e yerine getirme hakk\u0131na sahip oldu\u011fu (Madde 38) belirtilerek ibadet \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yer verilmi\u015ftir.<\/p>\n<p>Az\u0131nl\u0131klar\u0131n T\u00fcrk uyruklar\u0131 ile ayn\u0131 medeni ve siyasi haklardan faydalanacaklar\u0131 belirtirmi\u015f, hi\u00e7bir ayr\u0131m g\u00f6zetilmeksizin kanun \u00f6n\u00fcnde herkesin e\u015fit oldu\u011fu vurgulanm\u0131\u015ft\u0131r. Ayr\u0131ca az\u0131nl\u0131klara ili\u015fkin e\u011fitim veren kurumlar konusunda da gayrim\u00fcslimlere e\u011fitim- \u00f6\u011fretim kurumlar\u0131 a\u00e7ma, y\u00f6netme, az\u0131nl\u0131k dilini serbest\u00e7e kullanma, dini ayinlerini serbest\u00e7e yapma konusunda e\u015fit haklar tan\u0131nm\u0131\u015ft\u0131r (Madde 39).<\/p>\n<p>Lozan Antla\u015fmas\u0131 az\u0131nl\u0131klar\u0131n sadece dini y\u00f6n\u00fcn\u00fc esas alm\u0131\u015ft\u0131r. Ba\u015fka bir ifadeyle, T\u00fcrkiye Cumhuriyeti\u2019nin kabul etti\u011fi az\u0131nl\u0131k gruplar\u0131, \u201cdini az\u0131nl\u0131k\u201dlard\u0131r. Bu gruplar; Ermeniler, Museviler ve Rum- Ortodokslard\u0131r.<\/p>\n<p>G\u00fcn\u00fcm\u00fczde T\u00fcrkiye Cumhuriyeti\u2019nde ya\u015fayan az\u0131nl\u0131klara ili\u015fkin say\u0131sal verilere dayanarak bir de\u011ferlendirme yap\u0131ld\u0131\u011f\u0131nda, genel itibariyle Ermeni n\u00fcfusunun 50 bin, Musevilerin 27 bin, Rumlar\u0131n ise 3 bin dolay\u0131nda oldu\u011fu belirtilmektedir (3).<\/p>\n<p>Lozan\u2019\u0131n temel \u00f6zelliklerine bakt\u0131\u011f\u0131m\u0131zda ise az\u0131nl\u0131klara ili\u015fkin i\u00e7erdi\u011fi h\u00fck\u00fcmlere ayk\u0131r\u0131 hi\u00e7bir i\u015flem yap\u0131lamamas\u0131n\u0131n yan\u0131 s\u0131ra, az\u0131nl\u0131klara y\u00f6nelik getirdi\u011fi d\u00fczenlemelere dair bir ihlalin ger\u00e7ekle\u015fmesi durumunda yetkili merciinin; Uluslar aras\u0131 Daimi Adalet Divan\u0131, g\u00fcn\u00fcm\u00fczdeki ad\u0131yla \u201cUluslar aras\u0131 Adalet Divan\u0131\u201d olmas\u0131 \u00f6nemlidir.<\/p>\n<p><b>3) T\u00fcrkiye\u2019deki Az\u0131nl\u0131klar<br \/>\n<\/b><br \/>\n<b>3.1. Rum- Ortodokslar<br \/>\n<\/b><br \/>\nT\u00fcrkiye\u2019de \u0130stanbul, G\u00f6k\u00e7eada ve Bozcaada\u2019da yo\u011fun olarak ya\u015fayan etnik Rumlar\u0131n yan\u0131 s\u0131ra, etnik a\u00e7\u0131dan Rum olmayan, Arap\u00e7a ve T\u00fcrk\u00e7e konu\u015fan Antakya Rum Ortodoks H\u0131ristiyanlar\u0131 da mevcuttur. T\u00fcrkiye\u2019deki Rum n\u00fcfusun \u2013kesin olmamakla birlikte- 3 bin ile 5 bin aras\u0131nda oldu\u011fu ifade edilmektedir.<\/p>\n<p>Rum-Ortodoks az\u0131nl\u0131klar\u0131n sorunlar\u0131n\u0131 k\u0131saca ele alacak olursak; \u00fc\u00e7 temel sorundan bahsedebiliriz. Bu sorunlar; Heybeliada Ruhban Okulu(HRO)\u2019nun a\u00e7\u0131lmas\u0131, vak\u0131flar meselesi ve Ek\u00fcmenik Patriklik olgusudur.<\/p>\n<p><b>3.1.1. Heybeliada Ruhban Okulu (HRO)<br \/>\n<\/b><br \/>\n8 Haziran 1965 tarih ve 625 say\u0131l\u0131 \u00d6zel \u00d6\u011fretim Kurumlar\u0131 Kanunu\u2019nun baz\u0131 maddelerinin 12 Ocak 1971\u2019de Anayasa Mahkemesi\u2019nce iptali \u00fczerine, \u0130stanbul Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019n\u00fcn 12 A\u011fustos 1971 tarih ve \u00d6zel \u00d6\u011fretim Kurumlar\u0131 101787 say\u0131l\u0131 yaz\u0131s\u0131yla okulun y\u00fcksek k\u0131sm\u0131, 9 Temmuz 1971\u2019den ge\u00e7erli olmak \u00fczere kapat\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Rum Patrikhanesi\u2019nin \u00c7\u00f6z\u00fcm \u00d6nerisi: 1971\u2019de kapat\u0131lm\u0131\u015f olan HRO\u2019nun eski stat\u00fcs\u00fcyle aynen a\u00e7\u0131lmas\u0131d\u0131r. Bundan kastedilen stat\u00fc, MEB\u2019e ba\u011fl\u0131 \u201c\u00f6zel okul\u201d stat\u00fcs\u00fcd\u00fcr. Okulun y\u00f6netimi Rum Patrikhanesi\u2019nde, denetimi MEB\u2019deydi.<\/p>\n<p>Ermeni Patrikhanesi\u2019nin \u00c7\u00f6z\u00fcm \u00d6nerisi: Bir devlet \u00fcniversitesi b\u00fcnyesinde, \u201ckar\u015f\u0131la\u015ft\u0131rmal\u0131 din ara\u015ft\u0131rmalar\u0131\u201d gibi bir ad alt\u0131nda, her bir din ve mezhebe y\u00f6nelik olarak, \u00f6rne\u011fin \u201cErmeni dili ve k\u00fclt\u00fcr\u00fc,\u201d \u201cS\u00fcryani dili ve k\u00fclt\u00fcr\u00fc\u201d vb. adland\u0131r\u0131labilecek \u00e7e\u015fitli b\u00f6l\u00fcmler a\u00e7\u0131lmas\u0131n\u0131 \u00f6ng\u00f6rmektedir. M\u00fcfredat\u0131n haz\u0131rlanmas\u0131nda din\u00ee liderliklerin de s\u00f6z sahibi olmak istedi\u011fi bu b\u00f6l\u00fcmler \u201claik\u201d e\u011fitim verecekler, ancak \u00f6\u011frencilerin i\u00e7inden ruhan\u00ee olmak isteyenler, b\u00f6l\u00fcmde teorik bilgileri al\u0131rken, uygulamay\u0131 da bizzat kendi cemaatlerinin din\u00ee kurumlar\u0131nda \u00f6\u011freneceklerdir. Rum Patrikhanesi\u2019nin d\u0131\u015f\u0131nda hemen b\u00fct\u00fcn H\u0131ristiyan cemaatlerin \u00fczerinde anla\u015ft\u0131klar\u0131 form\u00fcld\u00fcr.<\/p>\n<p><b>3.1.2. Vak\u0131flar Meselesi<br \/>\n<\/b><br \/>\nT\u00fcrkiye\u2019deki gayrim\u00fcslim az\u0131nl\u0131klar, vak\u0131flar i\u00e7inde \u00f6rg\u00fctlenmi\u015ftir. 1935\u2019te kabul edilen Vak\u0131flar Kanunu (1936 Beyannamesi) ile vak\u0131flardan, Vak\u0131f B\u00f6lge M\u00fcd\u00fcrl\u00fckleri\u2019ne mal beyan\u0131nda bulunmalar\u0131 istenmi\u015ftir. Vak\u0131flar, vakfiye ile kurulur. Vakfiye, vak\u0131flar\u0131n kurulu\u015f amac\u0131n\u0131 belirler. Vak\u0131flar\u0131n vakfiyelerinin olmamas\u0131 sebebiyle vak\u0131flar, 2002\u2019ye kadar mal edinememi\u015ftir. 2002\u2019den itibaren ise AB\u2019ye uyum \u00e7er\u00e7evesinde vak\u0131flar\u0131n mal edinmelerine izin veren kanunlar (2002 ve 2008 Vak\u0131flar Kanunu) \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>4771 say\u0131l\u0131 Vak\u0131flar Kanunu: 2002\u2019de \u00e7\u0131kar\u0131lan bu kanun ile vakfiyeleri olsun ya da olmas\u0131n cemaat vak\u0131flar\u0131na Bakanlar Kurulu\u2019nun izniyle dini, sosyal, k\u00fclt\u00fcrel vb. alanlardaki ihtiya\u00e7lar\u0131n\u0131 gidermeleri i\u00e7in ta\u015f\u0131nmaz mal edinmek ve bu mallar \u00fczerinde tasarrufta bulunma hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>5737 say\u0131l\u0131 Vak\u0131flar Kanunu: 2008\u2019de \u00e7\u0131kar\u0131lan bu yasa ile ilgili olarak, T\u00fcrkiye\u2019nin de taraf oldu\u011fu Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi a\u00e7\u0131s\u0131ndan \u00f6nemli husus; ge\u00e7mi\u015fte vak\u0131ftan al\u0131nan mallar\u0131n \u00fc\u00e7\u00fcnc\u00fc ki\u015filere aktar\u0131lmas\u0131 durumunda sorunun nas\u0131l \u00e7\u00f6z\u00fclece\u011fi \u015feklindedir. Kamula\u015ft\u0131r\u0131lan mallar\u0131n birinci maliki, devlettir. Bu s\u00fcre zarf\u0131nda devletin, s\u00f6z konusu bu mallar\u0131 \u00fc\u00e7\u00fcnc\u00fc ki\u015filere devretmesi halinde zarar\u0131n nas\u0131l tazmin edilece\u011fi \u00e7\u00f6z\u00fcm bekleyen \u00f6nemli bir sorundur.<\/p>\n<p><b>3.1.3. Ek\u00fcmenik S\u0131fat\u0131<br \/>\n<\/b><br \/>\nPatrikhane\u2019nin ek\u00fcmenikli\u011fi; Ortodoks kiliseler aras\u0131nda koordinat\u00f6rl\u00fck, di\u011fer kiliselerle ili\u015fkiyi y\u00fcr\u00fcten merkez olma gibi i\u015flevleri ifade eden, tarihsel ve onursal bir unvand\u0131r. Ayn\u0131 zamanda fiilen, ba\u011f\u0131ms\u0131z Ortodoks kiliselerin, egemenlik alanlar\u0131n\u0131n d\u0131\u015f\u0131nda kalan b\u00f6lgelerde Patrikhane\u2019nin ruhani yetki sahibi olmas\u0131n\u0131 ifade etmektedir. Rum Patri\u011fi Bartholomeos\u2019 un bu s\u0131fat\u0131 edinmesine \u00e7e\u015fitli itirazlar gelmi\u015ftir. Ge\u00e7mi\u015fte Ortodoks kiliselerin hiyerar\u015fik bir yap\u0131lanmas\u0131 s\u00f6z konusu de\u011fildi. Fener Rum Patrikhanesi\u2019nin bu s\u0131fat\u0131 elde etmesinin s\u00f6z konusu olmas\u0131 halinde, Ortodoks kiliseler ile kar\u015f\u0131la\u015ft\u0131r\u0131ld\u0131\u011f\u0131nda Fener Rum Patrikhanesi\u2019nin primus inter pares yani \u201ce\u015fitler aras\u0131nda birinci\u201d konumuna gelecektir.<\/p>\n<p><b>3.2. Ermeniler<br \/>\n<\/b><br \/>\nAnadolu topraklar\u0131 \u00fczerinde ya\u015fayan en eski toplumlardan oldu\u011fu ifade edilen Ermenilerin T\u00fcrkiye\u2019deki n\u00fcfusu yakla\u015f\u0131k 50 bin civar\u0131nda oldu\u011fu belirtilmektedir. Yo\u011fun olarak ya\u015fad\u0131klar\u0131 \u015fehir ise \u0130stanbul\u2019dur.<\/p>\n<p>T\u00fcrkiye\u2019de ya\u015fayan Ermenilerin soyk\u0131r\u0131m iddialar\u0131 kar\u015f\u0131s\u0131ndaki tutumlar\u0131; iki toplum aras\u0131ndaki meselelerin 1915 olaylar\u0131 d\u0131\u015far\u0131da b\u0131rak\u0131larak tart\u0131\u015f\u0131lmas\u0131 y\u00f6n\u00fcndedir. Son zamanlarda siyasiler taraf\u0131ndan T\u00fcrkiye\u2019de ka\u00e7ak olarak ya\u015fayan Ermenilerin s\u0131n\u0131r d\u0131\u015f\u0131 edilmeleri gibi s\u00f6ylemlerde bulunulsa da resmi temaslar bak\u0131m\u0131ndan Ermenistan ile ili\u015fkilerin normalle\u015ftirilmesi y\u00f6n\u00fcnde ad\u0131mlar at\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><b>3.3. Museviler<br \/>\n<\/b><br \/>\nB\u00fcy\u00fck \u00e7o\u011funlu\u011fu 1492\u2019de \u0130spanya\u2019dan s\u00fcr\u00fclen Sefaradlard\u0131r. \u0130spanyolcaya benzeyen Ladino dilini kullan\u0131rlar. Yidi\u015f dilini kullanan A\u015fkenaziler de mevcuttur. 600 kadar\u0131 A\u015fkenazi olan 27 bin civar\u0131nda Musevi bulunmaktad\u0131r.
