Her T\u00fcrkiye Cumhuriyeti vatanda\u015f\u0131 Lozan Antla\u015fmas\u0131n\u0131n T\u00fcrkiye Cumhuriyeti devleti a\u00e7\u0131s\u0131ndan \u00e7ok b\u00fcy\u00fck bir \u00f6nemi haiz oldu\u011funu, Sevr Antla\u015fmas\u0131&#8217;na kar\u015f\u0131 T\u00fcrkiye h\u00fck\u00fcmetinin diplomatik anlamda ger\u00e7ek bir zaferi oldu\u011funu ilk\u00f6\u011frenimden itibaren \u00f6\u011frenerek b\u00fcy\u00fcr.<\/p>\n<p class=\"auto-style34\">Ancak Lozan Antla\u015fmas\u0131&#8217;nda az\u0131nl\u0131k stat\u00fcs\u00fc, farkl\u0131 k\u00f6kenlilere tan\u0131nan haklar\u0131n neler oldu\u011fu hi\u00e7 bilinmemektedir. Bu konuya ili\u015fkin bilgi edinilebilecek kaynak say\u0131s\u0131n\u0131n azl\u0131\u011f\u0131, bu \u00e7al\u0131\u015fmay\u0131 haz\u0131rlayanlar olarak bizde, Lozan&#8217;\u0131n \u00f6zellikle &#8220;Az\u0131nl\u0131klar\u0131n Korunmas\u0131&#8221; ba\u015fl\u0131kl\u0131 k\u0131sm\u0131na gereken ilgi ve \u00f6nemin verilmedi\u011fi, hatta bilinmemesi i\u00e7in \u00f6zel bir \u00e7aba g\u00f6sterildi\u011fi d\u00fc\u015f\u00fcncesi yaratm\u0131\u015ft\u0131r.<\/p>\n<p class=\"auto-style34\">Son zamanlarda az\u0131nl\u0131k haklar\u0131, kimlerin az\u0131nl\u0131k oldu\u011fu, T\u00fcrk\u00e7e&#8217;den ba\u015fka dilde yay\u0131n yap\u0131lmas\u0131 tart\u0131\u015fmalar\u0131 tekrar Lozan Antla\u015fmas\u0131&#8217;n\u0131n ilgi oda\u011f\u0131 olmas\u0131na neden olmu\u015f ve Lozan&#8217;\u0131n farkl\u0131 yorumlar\u0131 ortaya \u00e7\u0131kmaya ba\u015flam\u0131\u015ft\u0131r.<\/p>\n<p class=\"auto-style34\">Anadilde yay\u0131n yapma hakk\u0131n\u0131n Lozan&#8217;da tan\u0131nd\u0131\u011f\u0131n\u0131, Lozan&#8217;a dayan\u0131larak anadilde yay\u0131n yap\u0131labilece\u011fi, buna yasal bir engel bulunmad\u0131\u011f\u0131 g\u00f6r\u00fc\u015fleri ileri s\u00fcr\u00fclmektedir. Oysa T\u00fcrkiye Cumhuriyeti devleti Lozan&#8217;da sadece gayrim\u00fcslimlerin az\u0131nl\u0131k olarak kabul edildi\u011fini, bunun d\u0131\u015f\u0131nda T\u00fcrkiye&#8217;de ba\u015fka az\u0131nl\u0131k bulunmad\u0131\u011f\u0131 ve sadece gayrim\u00fcslim az\u0131nl\u0131klara haklar tan\u0131nd\u0131\u011f\u0131n\u0131 g\u00f6r\u00fc\u015f olarak bildirmektedir.<\/p>\n<p class=\"auto-style34\">Bu g\u00f6r\u00fc\u015f T\u00fcrkiye Cumhuriyetinin devaml\u0131-savundu\u011fu, hatta Anayasa Mahkemesi&#8217;nin parti kapatma davalar\u0131nda da temel gerek\u00e7esini olu\u015fturdu\u011fu resmi g\u00f6r\u00fc\u015f\u00fcd\u00fcr ve mevzuat\u0131n g\u00f6r\u00fcn\u00fcm\u00fc de bu y\u00f6ndedir.<\/p>\n<p class=\"auto-style34\">Peki ger\u00e7ekte Lozan Antla\u015fmas\u0131&#8217;nda durum nedir? Lozan Antla\u015fmas\u0131 kimlere hangi haklar\u0131 vermekte, kimleri az\u0131nl\u0131k olarak kabul etmektedir? Bu sorular\u0131n cevab\u0131n\u0131 bulmak i\u00e7in yine Lozan Antla\u015fmas\u0131&#8217;na ve konferans tutanaklar\u0131na bakmak gerekir.<\/p>\n<p class=\"auto-style34\">Bilindi\u011fi \u00fczere Lozan Bar\u0131\u015f Antla\u015fmas\u0131 \u0130ngiliz \u0130mparatorlu\u011fu, Fransa, \u0130talya, Japonya, Yunanistan, Romanya, S\u0131rp-H\u0131rvat-Sloven Devleti ile T\u00fcrkiye aras\u0131nda. 24 Temmuz 1923 tarihinde imzalanm\u0131\u015f ve T\u00fcrkiye Devletinin uluslararas\u0131 planda kurulu\u015funu belgeleyen bir metin olmu\u015ftur. Bizim bu \u00e7al\u0131\u015fmada \u00fczerinde duraca\u011f\u0131m\u0131z k\u0131s\u0131m antla\u015fman\u0131n &#8220;Az\u0131nl\u0131klar\u0131n Korunmas\u0131&#8221; ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131yan 37-45. maddeleridir.<\/p>\n<p class=\"auto-style34\">T\u00fcrkiye h\u00fck\u00fcmeti az\u0131nl\u0131k haklar\u0131n\u0131n Lozan Antla\u015fmas\u0131nda belirlenmesi ve koruma alt\u0131na al\u0131nmas\u0131n\u0131 uzun tart\u0131\u015fmalar ve belli kazan\u0131mlar sonucunda kabul etmi\u015ftir.\u00a0<b>(1)<\/b><\/p>\n<p class=\"auto-style34\">B\u00fcy\u00fck devletler, T\u00fcrkiye&#8217;yi sava\u015f\u0131 b\u0131rakmaya \u00e7a\u011f\u0131rarak, Do\u011fu Trakya&#8217;n\u0131n T\u00fcrkiye&#8217;ye geri verilmesi s\u00f6z\u00fcnde bulunduklar\u0131 zaman, T\u00fcrkiye&#8217;deki az\u0131nl\u0131klar\u0131n korunmas\u0131 i\u00e7in \u00f6zel garantiler kabul\u00fcn\u00fc \u015fart ko\u015fmu\u015flard\u0131. Konferansta bir\u00e7ok kez kesintiye u\u011frayan oturumlardan sonra az\u0131nl\u0131klar\u0131n korunmas\u0131 ba\u015fl\u0131kl\u0131 b\u00f6l\u00fcm \u00fczerinde anla\u015fmaya var\u0131labilmi\u015ftir.<\/p>\n<p class=\"auto-style34\">&#8220;Ancak Sevr Anla\u015fmas\u0131 ile kar\u015f\u0131la\u015ft\u0131r\u0131ld\u0131\u011f\u0131nda Lozan&#8217;da kabul edilen az\u0131nl\u0131k koruma h\u00fck\u00fcmlerinin, Sevr&#8217;deki a\u015f\u0131r\u0131l\u0131klar\u0131 ortadan kald\u0131rmakla kalmad\u0131\u011f\u0131n\u0131, d\u00f6nemin standart h\u00fck\u00fcmlerini de yeni T\u00fcrkiye Cumhuriyeti lehinde de\u011fi\u015ftirdi\u011fini s\u00f6yleyebiliriz.&#8221;\u00a0<b>(2)<\/b><\/p>\n<p class=\"auto-style33\">Lozan Konferans\u0131 tutanaklar\u0131 incelendi\u011finde, Az\u0131nl\u0131klar Alt Komisyonunun kar\u015f\u0131la\u015ft\u0131\u011f\u0131 temel sorun; az\u0131nl\u0131klar\u0131n korunmas\u0131 i\u00e7in konulacak h\u00fck\u00fcmlerin hangi kategoriye giren kimselere uygulanmas\u0131 gerekece\u011fini, kararla\u015ft\u0131rmak olmu\u015ftur. Alt Komisyon \u00f6nce b\u00fct\u00fcn etnik az\u0131nl\u0131klar\u0131n, ba\u015fka bir deyi\u015fle M\u00fcsl\u00fcman olmayan az\u0131nl\u0131klar gibi M\u00fcsl\u00fcman az\u0131nl\u0131klar\u0131n da\u00a0<b>-\u00f6rne\u011fin K\u00fcrtlerin, \u00c7erkezlerin ve Araplar\u0131n- koruma tedbirlerinden yararlanmalar\u0131nda\u00a0<\/b>\u0131srarc\u0131 olmu\u015ftu.<\/p>\n<p class=\"auto-style33\">Ancak T\u00fcrk heyetinin bu konuda direnmesi ve \u0130smet \u0130n\u00f6n\u00fc&#8217;n\u00fcn\u00a0<b>&#8220;T\u00fcrkiye&#8217;de hi\u00e7bir M\u00fcsl\u00fcman az\u0131nl\u0131k yoktur; \u00e7\u00fcnk\u00fc M\u00fcsl\u00fcman n\u00fcfusun \u00e7e\u015fitli unsurlar\u0131 aras\u0131nda hi\u00e7bir ay\u0131r\u0131m g\u00f6zetilmemektedir&#8221;<\/b>\u00a0y\u00f6n\u00fcndeki tart\u0131\u015fma kabul etmez itirazlar\u0131 neticesinde bu h\u00fck\u00fcmlerin sadece M\u00fcsl\u00fcman olmayan az\u0131nl\u0131klar\u0131 kapsamas\u0131 konusunda uzla\u015fma sa\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p class=\"auto-style33\">Alt Komisyon\u00a0<b>Lord Curzon&#8217;<\/b>a sundu\u011fu raporda &#8220;Az\u0131nl\u0131klar\u0131n korunmas\u0131na ili\u015fkin h\u00fck\u00fcmlerin T\u00fcrkiye&#8217;de oturan soy, dil ve din az\u0131nl\u0131klar\u0131n\u0131n -M\u00fcsl\u00fcman az\u0131nl\u0131klar\u0131 da i\u00e7ine almak \u00fczere- hepsine uygulanmas\u0131 konusunda uzun bir tart\u0131\u015fmadan sonra, genel kapsaml\u0131 olan bir maddeye dayanarak bu h\u00fck\u00fcmlerin uygulama alan\u0131n\u0131 M\u00fcsl\u00fcman olmayan az\u0131nl\u0131klarla s\u0131n\u0131rland\u0131r\u0131labilece\u011fini d\u00fc\u015f\u00fcnm\u00fc\u015ft\u00fcr.<\/p>\n<p class=\"auto-style34\">Alt Komisyon b\u00f6yle d\u00fc\u015f\u00fcn\u00fcrken &#8220;T\u00fcrkiye&#8217;nin do\u011fum, ulusal \u00f6zellik, dil, soy, ya da din ay\u0131r\u0131m\u0131 g\u00f6zetmeksizin, \u00fclkesinde oturan herkese, hayatlar\u0131 ve \u00f6zg\u00fcrl\u00fckleri bak\u0131m\u0131ndan tam ve eksiksiz bir koruma sa\u011flama y\u00fck\u00fcm\u00fcn\u00fc kabul edece\u011fini, T\u00fcrkiye&#8217;nin \u00fclkesinde oturan herkese, her dinin, mezhebin ya da inanc\u0131n gereklerini serbest\u00e7e yerine getirme hakk\u0131n\u0131 garanti alt\u0131na alm\u0131\u015f bulundu\u011funu da g\u00f6z \u00f6n\u00fcnde tutmu\u015ftur&#8221; denmektedir. Alt- Komisyon II. maddenin bu az\u0131nl\u0131klara yeter \u00f6l\u00e7\u00fcde koruma sa\u011flayaca\u011f\u0131 umudunda oldu\u011funu belirtmi\u015f, Lord Curzon ise buna pek g\u00fcvenmemekle birlikte, b\u00f6yle oldu\u011funu ummak istedi\u011fini beyan etmi\u015ftir.\u00a0<b>(3)<\/b><\/p>\n<p class=\"auto-style34\">M\u00fcsl\u00fcman az\u0131nl\u0131klar\u0131n da kapsama al\u0131nmas\u0131 konusu uzun tart\u0131\u015fmalara yol a\u00e7m\u0131\u015f, Alt Komisyonun bu konudaki g\u00f6r\u00fc\u015flerini etkilemesi ve T\u00fcrk heyetinin savunmas\u0131n\u0131 desteklemesi a\u00e7\u0131s\u0131ndan\u00a0<b>&#8220;konferans boyunca \u00f6nde gelen K\u00fcrt \u015fahsiyetlerine, Ankara&#8217;ya ve konferans sekretaryas\u0131na \u00e7ektirilen telgraflarda, K\u00fcrtlerin T\u00fcrklerle birlikte ya\u015fama azim ve karar\u0131nda olduklar\u0131 ifade edilmi\u015ftir.&#8221; (4)<\/b><\/p>\n<p class=\"auto-style34\"><b>Lozan&#8217;da Az\u0131nl\u0131k Stat\u00fcs\u00fc &#8211; Farkl\u0131 K\u00f6kenlilere Tan\u0131nan Haklar<\/b><\/p>\n<p class=\"auto-style33\">T\u00fcrk H\u00fck\u00fcmetinin gayretleri neticesinde Lozan&#8217;da sadece gayrim\u00fcslimler az\u0131nl\u0131k olarak say\u0131lm\u0131\u015ft\u0131r. Ancak Lozan&#8217;\u0131n tebli\u011fimizin de konusunu olu\u015fturan B\u00f6l\u00fcm l Kesim lll&#8217;\u00fcn\u00a0<b>&#8220;Az\u0131nl\u0131klar\u0131n Korunmas\u0131&#8221;<\/b>ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131yan 37-45. maddelerine bak\u0131ld\u0131\u011f\u0131ndan gayrim\u00fcslimlerin az\u0131nl\u0131k olarak tan\u0131nmas\u0131na ra\u011fmen, sadece gayrim\u00fcslim az\u0131nl\u0131klara haklar tan\u0131nmad\u0131\u011f\u0131, t\u00fcm T\u00fcrk uyruklar\u0131na, T\u00fcrk\u00e7e&#8217;den ba\u015fka dil konu\u015fan hatta daha da ileri gidilerek T\u00fcrkiye&#8217;de oturan herkese haklar tan\u0131nd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu anlamda bak\u0131ld\u0131\u011f\u0131ndan Lozan Antla\u015fmas\u0131 T\u00fcrkiye Cumhuriyeti&#8217;nin kurulu\u015f anla\u015fmas\u0131 olmas\u0131n\u0131n \u00f6tesinde, bir az\u0131nl\u0131k haklar\u0131 belgesi ve bir insan haklar\u0131 belgesi olarak da \u00e7ok b\u00fcy\u00fck bir \u00f6nem ta\u015f\u0131maktad\u0131r.<\/p>\n<p class=\"auto-style34\">Lozan Antla\u015fmas\u0131&#8217;n\u0131n maddeleri irdelendi\u011finde a\u011f\u0131rl\u0131kla gayrim\u00fcslim az\u0131nl\u0131klara haklar tan\u0131nd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Gayrim\u00fcslim az\u0131nl\u0131klar\u0131n;<\/p>\n<p class=\"auto-style34\">&#8211; 38\/3. maddesinde belirtilen b\u00fct\u00fcn T\u00fcrk uyruklar\u0131na uygulanan dola\u015f\u0131m ve g\u00f6\u00e7 etme \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden tam olarak yararland\u0131r\u0131laca\u011f\u0131,<\/p>\n<p class=\"auto-style34\">&#8211; 39\/1. maddesinde M\u00fcsl\u00fcmanlar\u0131n yararland\u0131klar\u0131 ayn\u0131 yurtta\u015fl\u0131k (medeni) haklar\u0131yla siyasal haklardan yararlanaca\u011f\u0131,<\/p>\n<p class=\"auto-style34\">&#8211; 40. maddede hukuk ve uygulama bak\u0131m\u0131ndan \u00f6teki T\u00fcrk uyruklar\u0131 ile ayn\u0131 i\u015flem ve garantilerden yararlanaca\u011f\u0131, hay\u0131r kurumu, dinsel sosyal kurumlar, her t\u00fcrl\u00fc okullar, \u00f6\u011fretim ve e\u011fitim kurumlar\u0131 kurmak, y\u00f6netmek ve denetlemek hakk\u0131, burada kendi dillerini serbest\u00e7e kullanma ve dinsel ayinlerini serbest\u00e7e yapmada e\u015fit hakka sahip olduklar\u0131,<\/p>\n<p class=\"auto-style34\">&#8211; 41. maddede \u00f6nemli oranda bulunduklar\u0131 il ve il\u00e7elerdeki ilkokullar\u0131nda anadillerinde e\u011fitim hakk\u0131,<\/p>\n<p class=\"auto-style34\">&#8211; 41\/2. maddesinde b\u00fct\u00e7eden pay alma hakk\u0131,<\/p>\n<p class=\"auto-style34\">&#8211; 42\/1. maddede aile ve ki\u015fisel durumlar\u0131 konusunda gelenek ve g\u00f6reneklerine uygun \u00e7\u00f6z\u00fcm hakk\u0131,<\/p>\n<p class=\"auto-style34\">&#8211; 42\/2. maddede din kurumlar\u0131na sayg\u0131, kurulu\u015flar\u0131 i\u00e7in gerekli kolayl\u0131klar\u0131n g\u00f6sterilmesi,<\/p>\n<p class=\"auto-style34\">&#8211; 43\/1. maddesinde inan\u00e7lar\u0131na ya da dinsel ayinlerine ayk\u0131r\u0131 davran\u0131\u015fta bulunmaya zorlanamayacaklar\u0131, hafta tatillerinde herhangi bir resmi i\u015flemi yerine getirmeye zorlanmama haklar\u0131 bulundu\u011fu belirtilmi\u015ftir.<\/p>\n<p class=\"auto-style34\">Bu maddelerde tan\u0131nan haklara bak\u0131ld\u0131\u011f\u0131nda Lozan Antla\u015fmas\u0131 ile T\u00fcrkiye&#8217;nin gayrim\u00fcslim az\u0131nl\u0131klara &#8220;pozitif ayr\u0131mc\u0131l\u0131k&#8221; yapmay\u0131 y\u00fck\u00fcmlendi\u011fi g\u00f6r\u00fclmektedir. Son y\u0131llarda e\u015fitlik ilkesi ve ayr\u0131mc\u0131l\u0131k yasa\u011f\u0131 anlay\u0131\u015f\u0131n\u0131n d\u0131\u015f\u0131nda, az\u0131nl\u0131k haklar\u0131n\u0131n niteli\u011fine ba\u011fl\u0131 &#8220;pozitif ayr\u0131mc\u0131l\u0131k&#8221; ilkesi de az\u0131nl\u0131k haklan normatif sisteminin kurucu unsurunu olu\u015fturmaktad\u0131r.\u00a0<b>(5)<\/b><\/p>\n<p class=\"auto-style34\">Pozitif ayr\u0131mc\u0131l\u0131k, genel yurtta\u015f kitlesinin sahip oldu\u011fu ve &#8220;negatif haklar&#8221; ad\u0131 verilen haklar\u0131n d\u0131\u015f\u0131nda ve \u00f6tesinde, tam ve etkili e\u015fitli\u011fin ger\u00e7ekle\u015ftirilmesi, az\u0131nl\u0131klar\u0131n kendilerine \u00f6zg\u00fc kimliklerini korumalar\u0131 i\u00e7in uygun ko\u015fullar\u0131n yarat\u0131lmas\u0131 anlam\u0131n\u0131 i\u00e7ermektedir. Lozan Antla\u015fmas\u0131 madde 41, 42 ve 43&#8217;te belirtildi\u011fi \u00fczere T\u00fcrkiye Cumhuriyeti devleti gayrim\u00fcslim az\u0131nl\u0131klara tan\u0131d\u0131\u011f\u0131 haklar\u0131n tam olarak ger\u00e7ekle\u015febilmesi ve T\u00fcrkiye&#8217;de ya\u015fayan di\u011fer T\u00fcrk uyruklar\u0131 ile tam ve etkili e\u015fitli\u011fi sa\u011flayabilmesi i\u00e7in tedbirler almak, kolayl\u0131klar g\u00f6stermek y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc de \u00fcstlenmi\u015ftir.<\/p>\n<p class=\"auto-style34\">Lozan&#8217;da gayrim\u00fcslim az\u0131nl\u0131klar d\u0131\u015f\u0131nda, t\u00fcm T\u00fcrk uyruklar\u0131na, T\u00fcrkiye&#8217;de oturan, T\u00fcrk\u00e7e&#8217;den ba\u015fka dil konu\u015fan herkese haklar tan\u0131nd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<b>\u00a0(6)<\/b><\/p>\n<p class=\"auto-style34\">&#8211; 39\/3. maddesinde &#8220;hi\u00e7bir T\u00fcrk uyru\u011funa din, mezhep ve inan\u00e7 ayr\u0131l\u0131\u011f\u0131 uygulanmayaca\u011f\u0131&#8221;, 39\/4. maddesinde &#8220;herhangi bir T\u00fcrk uyru\u011funun, gerek \u00f6zel gerekse ticari ili\u015fkilerinde, din, bas\u0131n ya da her \u00e7e\u015fit yay\u0131n konular\u0131yla a\u00e7\u0131k toplant\u0131lar\u0131nda, diledi\u011fi bir dili kullanmas\u0131na kar\u015f\u0131 hi\u00e7bir k\u0131s\u0131tlama konulmayaca\u011f\u0131&#8221; h\u00fck\u00fcmlerinin T\u00fcrk uyruklar\u0131n\u0131n tamam\u0131 i\u00e7in kabul edildi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p class=\"auto-style34\">&#8211; 39\/5. maddesinde ise &#8220;T\u00fcrk\u00e7e&#8217;den ba\u015fka bir dil konu\u015fan T\u00fcrk uyruklar\u0131na mahkemelerde kendi dillerini s\u00f6zl\u00fc olarak kullanabilmeleri bak\u0131m\u0131ndan uygun d\u00fc\u015fen kolayl\u0131klar\u0131n sa\u011flanaca\u011f\u0131&#8221; belirtilmi\u015ftir. Bu madde de T\u00fcrk\u00e7e&#8217;den ba\u015fka dil konu\u015fulanlar denmekle sadece gayrim\u00fcslim az\u0131nl\u0131klar de\u011fil, anadili T\u00fcrk\u00e7e&#8217;den ba\u015fka olan t\u00fcm T\u00fcrk uyruklar\u0131 anla\u015f\u0131lmal\u0131d\u0131r. Bu madde ile anadili T\u00fcrk\u00e7e&#8217;den ba\u015fka olan uyruklara pozitif hak tan\u0131nd\u0131\u011f\u0131 ve di\u011fer uyruklardan farkl\u0131 olarak kendi dillerini mahkemelerde kullanabilmeleri i\u00e7in kolayl\u0131k sa\u011flama y\u00fck\u00fcm\u00fc getirildi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p class=\"auto-style34\">&#8211; 38\/1, maddesinde &#8220;T\u00fcrk h\u00fck\u00fcmeti, T\u00fcrkiye&#8217;de oturan herkesin, do\u011fum, bir ulusal topluluktan olma, (milliyet), dil, soy ya da din ayr\u0131m\u0131 yapmaks\u0131z\u0131n, hayatlar\u0131n\u0131 ve \u00f6zg\u00fcrl\u00fcklerini korumay\u0131 y\u00fck\u00fcmlenir&#8221; denilmekte ve devamla 38\/2. maddesinde &#8220;T\u00fcrkiye&#8217;de oturan herkesin her dinin ya da her mezhebin gereklerini a\u00e7\u0131k\u00e7a ya da \u00f6zel olarak serbest\u00e7e yerine getirme hakk\u0131na sahiptir&#8221; denilmektedir.<\/p>\n<p class=\"auto-style34\">&#8211; 39\/2. maddesinde de &#8221; T\u00fcrkiye&#8217;de oturan herkes din ayr\u0131m\u0131 g\u00f6zetilmeksizin kanun \u00f6n\u00fcnde e\u015fittir&#8221; denilmektedir.<\/p>\n<p class=\"auto-style34\">Getirilen bu haklar\u0131n g\u00fcvencesi ise Lozan Antla\u015fmas\u0131n\u0131n 37.maddesi&#8217;dir. Buna g\u00f6re &#8220;T\u00fcrkiye 38. maddeden 44. maddeye kadar olan maddelerin kapsad\u0131\u011f\u0131 h\u00fck\u00fcmlerin temel yasalar olarak tan\u0131nmas\u0131n\u0131 ve hi\u00e7bir kanunun, hi\u00e7bir y\u00f6netmeli\u011fin (t\u00fcz\u00fc\u011f\u00fcn) ve hi\u00e7bir resmi i\u015flemin, bu h\u00fck\u00fcmlere ayk\u0131r\u0131 ya da bunlarla \u00e7eli\u015fir olmamas\u0131n\u0131 ve hi\u00e7bir kanun, hi\u00e7bir y\u00f6netmelik ve hi\u00e7bir i\u015flemin s\u00f6z konusu h\u00fck\u00fcmlerden \u00fcst\u00fcn say\u0131lmamas\u0131n\u0131 y\u00fck\u00fcmlenir&#8221;. Bu maddeye g\u00f6re, T\u00fcrk h\u00fck\u00fcmeti Lozan Antla\u015fmas\u0131&#8217;n\u0131 temel yasa olarak kabul etmi\u015f ve buna ayk\u0131r\u0131 hi\u00e7bir d\u00fczenleme yapmamay\u0131 y\u00fck\u00fcmlenmi\u015ftir. \u015eimdi Lozan&#8217;da haklar tan\u0131nan gruplara g\u00f6re 37. maddenin nas\u0131l uyguland\u0131\u011f\u0131n\u0131 \u0130rdelemeye ba\u015flayabiliriz.<\/p>\n<p class=\"auto-style34\"><b>1. Gayrim\u00fcslim Az\u0131nl\u0131klar A\u00e7\u0131s\u0131ndan 37. Madde Uygulamas\u0131<\/b><\/p>\n<p class=\"auto-style34\">T\u00fcrkiye Cumhuriyeti Devleti Lozan Antla\u015fmas\u0131nda kabul etti\u011fi az\u0131nl\u0131k haklar\u0131n\u0131n ya\u015fama ge\u00e7irilmesi konusunda hi\u00e7bir zaman istekli olmam\u0131\u015f, Lozan&#8217;da az\u0131nl\u0131klara tan\u0131nan haklan tam olarak i\u00e7ine sindirememi\u015f, buna ra\u011fmen, g\u00f6r\u00fc\u015fmelerin t\u0131kanmamas\u0131 i\u00e7in onaylamak zorunda kalm\u0131\u015ft\u0131r. Ancak T\u00fcrkiye Cumhuriyeti bu maddeleri d\u0131\u015f devletlerin T\u00fcrkiye&#8217;nin i\u00e7 i\u015flerine m\u00fcdahalesi olarak g\u00f6rmeye devam etmi\u015f ve uygulanmas\u0131n! engellemek i\u00e7in \u00e7e\u015fitli y\u00f6ntemler denemi\u015ftir.<\/p>\n<p class=\"auto-style34\">\u00d6ncelikle yo\u011fun bir T\u00fcrkle\u015ftirme politikas\u0131 uygulanm\u0131\u015ft\u0131r. R\u0131fat N. Bali\u00a0<b>(7),<\/b>\u00a0Ayhan Aktar&#8217;\u0131n &#8220;Cumhuriyetin \u0130lk Y\u0131llar\u0131nda Uygulanan T\u00fcrkle\u015ftirme Politikalar\u0131&#8217; &#8221; adl\u0131 makalesinden al\u0131nt\u0131layarak \u015funlar\u0131 aktar\u0131yor: &#8220;T\u00fcrkle\u015ftirme siyaseti sokakta konu\u015fulan dilden, okullarda \u00f6\u011fretilecek tarihe; e\u011fitimden sanayi hayat\u0131na; ticaretten devlet personel rejimine; \u00f6zel hukuktan vatanda\u015flar\u0131n belli y\u00f6relerde isk\u00e2n\u0131na kadar toplumsal hayat\u0131n her boyutunda ge\u00e7erli idi&#8221;.\u00a0<b>(8)<\/b><\/p>\n<p class=\"auto-style34\">Bu ama\u00e7la T\u00fcrkiye Cumhuriyeti devleti antla\u015fman\u0131n 37 maddesi gere\u011fince, Lozan&#8217;a ayk\u0131r\u0131 yasa, y\u00f6netmelik vb hi\u00e7bir d\u00fczenleme yapamayaca\u011f\u0131ndan b\u00fcrokratik engeller, resmi i\u015flemlerde zorluklar \u00e7\u0131kararak az\u0131nl\u0131klara tan\u0131nan haklar\u0131n tam olarak kullan\u0131m\u0131n\u0131 engelleme yoluna gitmi\u015ftir.<\/p>\n<p class=\"auto-style34\">Bu politika kapsam\u0131nda T\u00fcrkiye&#8217;de bulunan az\u0131nl\u0131klar\u0131n haklar\u0131 konusundaki uygulama, uluslararas\u0131 konjonkt\u00fcre uygun olarak de\u011fi\u015fiklikler arz etmi\u015f, T\u00fcrkiye Cumhuriyeti vatanda\u015f\u0131 olan az\u0131nl\u0131klar uluslararas\u0131 arenada bir koz olarak kullan\u0131lm\u0131\u015ft\u0131r. \u00d6rne\u011fin 1964 K\u0131br\u0131s olaylar\u0131 s\u0131ras\u0131nda ilk \u00f6nce \u0130stanbul&#8217;da Rum ad\u0131n\u0131 \u00e7a\u011fr\u0131\u015ft\u0131ran semt isimleri de\u011fi\u015ftirilmeye ba\u015flanm\u0131\u015ft\u0131r. (Galata&#8217;n\u0131n ad\u0131n\u0131n Karak\u00f6y, Samatya&#8217;n\u0131n ad\u0131n\u0131n Kocamustafapa\u015fa, A\u011fva&#8217;n\u0131n ad\u0131n\u0131n Ye\u015fil\u00e7ay olarak de\u011fi\u015ftirilmesi gibi).<\/p>\n<p class=\"auto-style34\">Programl\u0131 bir \u015fekilde y\u00fcr\u00fct\u00fclen &#8220;Vatanda\u015f T\u00fcrk\u00e7e konu\u015f&#8221; &#8220;T\u00fcrk&#8217;ten T\u00fcrk&#8217;e al\u0131\u015fveri\u015f&#8221; kampanyalar\u0131 T\u00fcrkiye&#8217;yi az\u0131nl\u0131klardan ar\u0131nd\u0131rma ve T\u00fcrkle\u015ftirme \u00e7abalar\u0131n\u0131n \u00f6rnekleridir.<\/p>\n<p class=\"auto-style34\">Bu kampanyalar\u0131n d\u0131\u015f\u0131nda, az\u0131nl\u0131klar\u0131n iktisaden de \u00e7\u00f6kertilmesi ve etkinliklerinin azalt\u0131lmas\u0131 amac\u0131yla sistemli \u00e7al\u0131\u015fmalar y\u00fcr\u00fct\u00fclm\u00fc\u015ft\u00fcr. Varl\u0131k Vergisi, 20 Kur&#8217;a Askerlik gibi uygulamalar bunun \u00e7arp\u0131c\u0131 \u00f6rnekleridir.<\/p>\n<p class=\"auto-style34\">Lozan Antla\u015fmas\u0131&#8217;n\u0131n 42. maddesinde &#8220;T\u00fcrk h\u00fck\u00fcmeti az\u0131nl\u0131klar\u0131n T\u00fcrkiye&#8217;deki vak\u0131flar\u0131na, din ve hay\u0131r i\u015fleri kurumlar\u0131na her t\u00fcrl\u00fc kolayl\u0131klar ve izinler sa\u011flayacak ve T\u00fcrk h\u00fck\u00fcmeti, yeniden din ve hay\u0131r kurumlar\u0131 kurulmas\u0131 i\u00e7in, bu nitelikteki \u00f6teki \u00f6zel kurumlara sa\u011flanm\u0131\u015f gerekli kolayl\u0131klardan hi\u00e7birini esirgemeyecektir&#8221; denilmesine kar\u015f\u0131n, laiklik ilkesine ayk\u0131r\u0131 oldu\u011fu gerek\u00e7esi ile ruhban okullar\u0131 kurulmas\u0131 engellenmektedir. (Oysa imam hatip okullar\u0131n\u0131n a\u00e7\u0131lmas\u0131 laiklik ilkesine ayk\u0131r\u0131l\u0131k te\u015fkil etmemektedir.)<\/p>\n<p class=\"auto-style33\">Yenilerinin kurulmas\u0131n\u0131 desteklemek bir yana az\u0131nl\u0131k vak\u0131flar\u0131n\u0131n gayrimenkullerine el konulmakta, ekonomik olarak a\u00e7maza sokulmaktad\u0131rlar. Kamuoyunda\u00a0<b>&#8220;36 Beyannamesi sorunu&#8221;\u00a0<\/b>olarak bilinen konu, bu durumu g\u00f6steren en \u00e7arp\u0131c\u0131 \u00f6rnektir. Bu \u015fekilde az\u0131nl\u0131k vak\u0131flar\u0131n\u0131n bir\u00e7ok gayrimenkulleri ellerinden al\u0131nm\u0131\u015f, ba\u011f\u0131\u015f, vasiyet, vs herhangi bir yolla gayrimenkul edinmelerinin \u00f6n\u00fcne ge\u00e7ilmi\u015ftir.<\/p>\n<p class=\"auto-style34\">Lozan&#8217;a ayk\u0131r\u0131 olan uygulamalar bunlarla s\u0131n\u0131rl\u0131 de\u011fildir. \u00d6rne\u011fin; Lozan Antla\u015fmas\u0131&#8217;nda az\u0131nl\u0131k okullar\u0131na, kiliselere ve hastanelere yerel y\u00f6netim b\u00fct\u00e7elerinden hakkaniyete uygun paylar verilece\u011fi h\u00fckm\u00fc hi\u00e7bir zaman yerine getirilmedi\u011fi gibi, tam aksine uygulamalar yap\u0131lm\u0131\u015f, hatta Maliye Bakanl\u0131\u011f\u0131 bu okul ve hastanelerden vergi talep etmi\u015ftir. S\u00fcryaniler, H\u0131ristiyan olmas\u0131na ra\u011fmen okul a\u00e7amamakta, Ermeni veya Rum olmad\u0131klar\u0131 gerek\u00e7esi ile bu cemaatlerin kurduklar\u0131 okullara da al\u0131nmalar\u0131na engel olunmakta, Lozan&#8217;a ra\u011fmen kendi dillerinde e\u011fitim yapma haklar\u0131 ellerinden al\u0131nmaktad\u0131r.<\/p>\n<p class=\"auto-style34\">Madde 39\/3&#8217;te &#8220;din ve mezhep ayr\u0131l\u0131\u011f\u0131n\u0131n yurtta\u015fl\u0131k haklar\u0131yla siyasal haklardan yararlanmada, kamu hizmet ve g\u00f6revlerine kabul edilme ve y\u00fckseltilme, onurlanma ya da \u00e7e\u015fitli mesleklerde ve i\u015fkollar\u0131nda \u00e7al\u0131\u015fma bak\u0131m\u0131ndan engel say\u0131lmayaca\u011f\u0131&#8221;na h\u00fckmedilmi\u015fse de, gayrim\u00fcslim az\u0131nl\u0131klar polis okullar\u0131na ve askeri okullara al\u0131nmad\u0131\u011f\u0131 gibi, \u00f6\u011fretim g\u00f6revlili\u011fi d\u0131\u015f\u0131nda \u00fcst d\u00fczey devlet memuru oldu\u011fu da g\u00f6r\u00fclmemektedir.<\/p>\n<p class=\"auto-style34\">Az\u0131nl\u0131klar\u0131n haklar\u0131n\u0131 tam olarak kullanabilmeleri i\u00e7in gerekli olan yasal d\u00fczenlemeler yap\u0131lmamakta, bazen yasa olmakta ancak uygulanabilmesi i\u00e7in gerekli y\u00f6netmelik \u00e7\u0131kar\u0131lamamaktad\u0131r. Daha da k\u00f6t\u00fcs\u00fc az\u0131nl\u0131klara ili\u015fkin baz\u0131 i\u015flemler Resmi Gazete&#8217;de yay\u0131nlanmayan &#8220;gizli kararnameler&#8221; ile y\u00fcr\u00fct\u00fclmektedir. Bu kararnamelerden ancak davalar s\u0131ras\u0131nda dosyaya sunulmas\u0131 halinde bilgi sahibi olunmakta ve bu hukuken sakat kararnamelere dayan\u0131larak kararlar verilmekte, az\u0131nl\u0131klar hukuken ma\u011fdur edilmektedir.<\/p>\n<p class=\"auto-style34\"><b>2- Lozan ile Haklar Tan\u0131nan Di\u011fer Gruplar A\u00e7\u0131s\u0131ndan 37. Madde Uygulamas\u0131<\/b><\/p>\n<p class=\"auto-style34\">Bu a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda T\u00fcrkiye Cumhuriyeti devleti Lozan Antla\u015fmas\u0131&#8217;na uygun davranmamakta ve y\u00fck\u00fcml\u00fcl\u00fcklerinin aksine yasal d\u00fczenlemeler yaparak 37. madde h\u00fckm\u00fcn\u00fc s\u00fcrekli ihlal etmektedir. Oysa Lozan Antla\u015fmas\u0131 ve ekleri 23.08.1923 tarih ve 341,342,343,344 say\u0131l\u0131 yasalarla i\u00e7 hukuk haline getirilmi\u015ftir. Anayasan\u0131n 90\/5. maddesi gere\u011fince &#8220;Usul\u00fcne g\u00f6re y\u00fcr\u00fcrl\u00fc\u011fe konmu\u015f milletleraras\u0131 antla\u015fmalar kanun h\u00fckm\u00fcndedir. Bunlar hakk\u0131nda anayasaya ayk\u0131r\u0131l\u0131k iddias\u0131yla Anayasa Mahkemesi&#8217;ne ba\u015fvurulamaz.&#8221;<\/p>\n<p class=\"auto-style34\">Anayasa&#8217;n\u0131n bu a\u00e7\u0131k h\u00fckm\u00fc gere\u011fince Lozan Antla\u015fmas\u0131&#8217;n\u0131n temel yasa olarak uygulanmas\u0131 ve buna ayk\u0131r\u0131 hi\u00e7bir d\u00fczenleme yap\u0131lmamas\u0131 gerekmektedir. Oysa mevzuat\u0131m\u0131z incelendi\u011finde durumun b\u00f6yle olmad\u0131\u011f\u0131 da g\u00f6r\u00fclmektedir. Bu konuda Av. Aynur Ayzit ayr\u0131nt\u0131l\u0131 bilgi verece\u011finden birka\u00e7 \u00f6rnekle yetinilecektir.<\/p>\n<p class=\"auto-style34\">&#8211; Lozan&#8217;\u0131n 39\/4. maddesinde &#8220;herhangi bir T\u00fcrk uyru\u011funun gerek \u00f6zel gerek ticari ili\u015fkilerinde, bas\u0131n veya her \u00e7e\u015fit yay\u0131n konular\u0131nda, a\u00e7\u0131k toplant\u0131lar\u0131nda diledi\u011fi dili kullanmas\u0131na hi\u00e7bir k\u0131s\u0131tlama konulmayacakt\u0131r&#8221; denilmektedir. Bu madde gere\u011fince her T\u00fcrk vatanda\u015f\u0131 T\u00fcrk\u00e7e&#8217;den ba\u015fka dille &#8211; K\u00fcrt\u00e7e, Lazca, \u00c7erkezce vb- her \u00e7e\u015fit yay\u0131n yapabilir. \u00d6rne\u011fin televizyon kurabilir. Peki bunu ger\u00e7ekte yapabilir mi? Tabii ki hay\u0131r. Her ne kadar Lozan buna cevaz verse de RT\u00dcK T\u00fcrk\u00e7e&#8217;den ba\u015fka dilde yay\u0131n yap\u0131lmas\u0131na izin vermemektedir. B\u0131rak\u0131n televizyon yay\u0131n\u0131 yap\u0131lmas\u0131n\u0131, K\u00fcrt\u00e7e tiyatro oyunu sergilenmesine dahi izin verilmemektedir. Bu durum Lozan Antla\u015fmas\u0131&#8217;na a\u00e7\u0131k ayk\u0131r\u0131l\u0131k ta\u015f\u0131maktad\u0131r.<\/p>\n<p class=\"auto-style34\">Oysa mevzuat\u0131n Lozan&#8217;a ayk\u0131r\u0131 olmas\u0131, Lozan Antla\u015fmas\u0131 h\u00fck\u00fcmlerinin uygulanmas\u0131na engel te\u015fkil etmemeli, tam tersine Lozan temel yasa olarak kabul edildi\u011finden, Lozan&#8217;a ayk\u0131r\u0131 olan yasalar\u0131n de\u011fil, Lozan h\u00fck\u00fcmlerinin uygulanmas\u0131 suretiyle soruna \u00e7\u00f6z\u00fcm bulmak gerekmektedir.<\/p>\n<p class=\"auto-style34\">Antla\u015fman\u0131n 39\/5. maddesinde &#8220;T\u00fcrk\u00e7e&#8217;den ba\u015fka dil konu\u015fan T\u00fcrk vatanda\u015flar\u0131na mahkemelerde s\u00f6zl\u00fc olarak savunma s\u0131ras\u0131nda gerekli kolayl\u0131klar sa\u011flanacakt\u0131r&#8221; denilmesine ra\u011fmen, fiilen bu maddeye de ayk\u0131r\u0131 davran\u0131ld\u0131\u011f\u0131, \u00d6zellikle ola\u011fan\u00fcst\u00fc hal b\u00f6lgesinde anadilde savunma yapmak i\u00e7in gerekli kolayl\u0131klar\u0131n g\u00f6sterilmedi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p class=\"auto-style34\"><b>Lozan Antla\u015fmas\u0131 45. Maddenin Yorumu<\/b><\/p>\n<p class=\"auto-style34\">Lozan Antla\u015fmas\u0131n\u0131n 45. maddesi &#8220;bu kesimdeki h\u00fck\u00fcmlerle, T\u00fcrkiye&#8217;nin M\u00fcsl\u00fcman olmayan az\u0131nl\u0131klar\u0131na tan\u0131m\u0131\u015f oldu\u011fu haklar, Yunanistan&#8217;ca da, kendi \u00fclkesinde bulunan M\u00fcsl\u00fcman az\u0131nl\u0131\u011fa tan\u0131nm\u0131\u015ft\u0131r&#8221; demektedir.<\/p>\n<p class=\"auto-style34\">Bu madde her iki devlete de \u00fclkesindeki vatanda\u015f\u0131 olan az\u0131nl\u0131klara ayn\u0131 haklan tan\u0131ma zorunlulu\u011funu getirmi\u015ftir. Ancak ne yaz\u0131k ki uygulamada, bu bir kar\u015f\u0131l\u0131kl\u0131l\u0131k ve mukabele-i bi\u00eemisil olarak g\u00f6r\u00fclmekte ve Yunanistan&#8217;\u0131n M\u00fcsl\u00fcman az\u0131nl\u0131klara kar\u015f\u0131 Lozan&#8217;\u0131 ihlal eder herhangi bir uygulamas\u0131, T\u00fcrkiye&#8217;deki gayrim\u00fcslim vatanda\u015flara da T\u00fcrkiye taraf\u0131ndan ayn\u0131 y\u00f6nde uygulama yap\u0131lmas\u0131na, ya da tersi durumlarda, T\u00fcrkiye&#8217;nin yapt\u0131\u011f\u0131 bir uygulama, Yunanistan taraf\u0131ndan M\u00fcsl\u00fcman az\u0131nl\u0131klara ayn\u0131 y\u00f6nde uygulama yap\u0131lmas\u0131na neden olmaktad\u0131r. Oysa her iki \u00fclkede yer alan az\u0131nl\u0131klar o \u00fclkenin vatanda\u015f\u0131d\u0131r ve bir \u00fclke kendi vatanda\u015f\u0131na mukabele-i bilmisil, kar\u015f\u0131l\u0131kl\u0131l\u0131k uygulayamaz. Lozan&#8217;\u0131n ihlali bu iki \u00fclkeden herhangi birine mukabele-i bilmisil ya da kar\u015f\u0131l\u0131kl\u0131l\u0131k uygulama imk\u00e2n\u0131 verir \u015fekilde yorumlanamaz. Bu yorum ve uygulama hatal\u0131 olmas\u0131na ra\u011fmen bug\u00fcne kadar ne yaz\u0131k ki bu \u015fekilde uygulanm\u0131\u015ft\u0131r. Ancak bu durum her iki \u00fclke a\u00e7\u0131s\u0131ndan da Lozan&#8217;\u0131n a\u00e7\u0131k ihlalidir.<\/p>\n<p class=\"auto-style34\"><b>Sonu\u00e7<\/b><\/p>\n<p class=\"auto-style34\">&#8211; Lozan Antla\u015fmas\u0131&#8217;nda yukar\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z \u00fczere sadece gayrim\u00fcslim vatanda\u015flar az\u0131nl\u0131k olarak kabul edilmi\u015f, ancak T\u00fcrkiye&#8217;de oturan, T\u00fcrk\u00e7e&#8217;den ba\u015fka dil konu\u015fan t\u00fcm T\u00fcrk uyruklar\u0131na da haklar tan\u0131nm\u0131\u015ft\u0131r. Gayrim\u00fcslimlere tan\u0131nan haklar\u0131n g\u00fcvencesi madde 44 gere\u011fince uluslararas\u0131 g\u00fcvence olmas\u0131na kar\u015f\u0131n, di\u011fer gruplar i\u00e7in b\u00f6yle bir g\u00fcvence bulunmamaktad\u0131r.
