Malumunuz, bir kel i\u00e7i\u015fleri bakan\u0131m\u0131z var. Bu kel, hocalar\u0131n hocas\u0131 Bask\u0131n Oran\u2019a hakaret ediyor, Tayyip Mahkemeleri de bu keli su\u00e7suz buluyor. Olay\u0131n \u00f6ncesini sonras\u0131n\u0131 aynen aktaray\u0131m.<\/p>\n
Prof. Dr. Bask\u0131n Oran\u2019a, 2017 y\u0131l\u0131ndaki \u2018K\u00fcrtler \u00dczerine Baz\u0131 Trajikomik Deneyler\u2019 ba\u015fl\u0131kl\u0131 yaz\u0131s\u0131 nedeniyle hakarette bulunan \u0130\u00e7i\u015fleri Bakan\u0131 S\u00fcleyman Soylu hakk\u0131nda, istinaf mahkemesi de cezaya yer olmad\u0131\u011f\u0131na karar verdi.<\/p>\n
Ankara B\u00f6lge Adliye Mahkemesi 25. Hukuk Dairesi, \u0130\u00e7i\u015fleri Bakan\u0131 S\u00fcleyman Soylu\u2019nun, Prof. Dr. Bask\u0131n Oran\u2019a y\u00f6nelik \u2018al\u00e7ak\u2019 ve \u2018u\u015fak\u2019 ifadelerinin d\u00fc\u015f\u00fcnce \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131 i\u00e7inde kald\u0131\u011f\u0131na h\u00fckmetti. \u0130stinaf mahkemesi b\u00f6ylece Bask\u0131n Oran\u2019\u0131n manevi tazminat davas\u0131n\u0131 reddeden yerel mahkeme karar\u0131n\u0131 onam\u0131\u015f oldu.<\/p>\n
Dava s\u00fcreci, Emekli \u00d6\u011fretim \u00dcyesi Bask\u0131n Oran\u2019\u0131n 23 Haziran 2017\u2019de hi\u00e7bir yorum ta\u015f\u0131maks\u0131z\u0131n birbiri ard\u0131na kronolojik olarak s\u0131ralanm\u0131\u015f gazete haberlerinden olu\u015fan \u2018K\u00fcrtler \u00dczerine Baz\u0131 Trajikomik Deneyler\u2019 ba\u015fl\u0131kl\u0131 yaz\u0131s\u0131yla ba\u015flad\u0131. \u0130\u00e7i\u015fleri Bakan\u0131 Soylu, s\u00f6z konusu yaz\u0131yla ilgili olarak Twitter hesab\u0131ndan \u201cKendisini ilim adam\u0131 diye pazarlam\u0131\u015f yaz\u0131s\u0131n\u0131n her kelimesini al\u00e7ak\u00e7a kurgulam\u0131\u015f bir u\u015fak Bask\u0131n Oran hakk\u0131nda su\u00e7 duyurusunda bulunuyorum\u201d payla\u015f\u0131m\u0131 yapt\u0131.<\/p>\n
Soylu\u2019nun bu payla\u015f\u0131m\u0131n\u0131n ard\u0131ndan \u0130stanbul Ba\u015fsavc\u0131l\u0131\u011f\u0131 da, Bask\u0131n Oran hakk\u0131nda soru\u015fturma a\u00e7t\u0131. Savc\u0131l\u0131k soru\u015fturma sonunda, yaz\u0131da su\u00e7 unsuru bulunmad\u0131\u011f\u0131n\u0131 belirterek, kovu\u015fturmaya yer olmad\u0131\u011f\u0131na karar verdi. Prof. Dr. Bask\u0131n Oran, karar \u00fczerine Soylu hakk\u0131nda, kendisine \u2018al\u00e7ak\u2019 ve \u2018u\u015fak\u2019 diyerek ki\u015filik haklar\u0131n\u0131 zedeledi\u011fi i\u00e7in Ankara 14. Asliye Hukuk Mahkemesinde manevi tazminat davas\u0131 a\u00e7t\u0131. Prof. Dr. Oran duru\u015fmada \u201cBana daval\u0131n\u0131n tweetiyle y\u00f6neltilen s\u00f6zlerin, benim taraf\u0131mdan daval\u0131ya aynen y\u00f6neltilmesi halinde ne karar verecek idiyseniz, o \u015fekilde karar vermenizi talep ediyorum.\u201d dedi.<\/p>\n
Mahkeme, Oran\u2019\u0131n tazminat davas\u0131n\u0131 reddetti. Mahkeme karar\u0131nda, Bask\u0131n Oran\u2019\u0131n makalesinden \u2018bildiri\u2019 diye bahsedilmesi, s\u00f6z konusu yaz\u0131n\u0131n heyet taraf\u0131ndan okunup okunmad\u0131\u011f\u0131 sorusunu beraberinde getirdi. Bask\u0131n Oran bunun \u00fczerine davay\u0131 istinaf mahkemesine ta\u015f\u0131d\u0131. Oran\u2019\u0131n ba\u015fvurusunda, \u201cBakan S\u00fcleyman Soylu\u2019nun ele\u015ftirisi varsa bunu hakaret etmeden de yapabilece\u011fi\u201d ifade edildi. Ancak Ankara B\u00f6lge Adliye Mahkemesi 25. Hukuk Dairesi, yerel mahkemenin ret karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131n\u0131 oy birli\u011fiyle reddetti. Mahkeme, \u2018al\u00e7ak\u2019 ve \u2018u\u015fak\u2019 s\u00f6zlerinin \u2018ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc\u2019 s\u0131n\u0131rlar\u0131 i\u00e7inde oldu\u011funu s\u00f6yledi. Oran, istinaf mahkemesinin karar\u0131n\u0131 temyiz talebiyle Yarg\u0131taya ta\u015f\u0131d\u0131.<\/p>\n
Sonu\u00e7 olarak, bu kelin ilk vukuat\u0131 de\u011fil. Adam \u0130\u00e7\u015fileri Bakan\u0131 de\u011fil, bildi\u011fin tetik\u00e7i. O kadar ars\u0131zca va ahlaks\u0131zca i\u015fler yap\u0131yor ki, b\u0131rak\u0131n demokratik \u00fclkeleri \u00e7ad\u0131r devletlerinde bile an\u0131nda kodese t\u0131karlar. Ama bu \u00fclkek \u00e7ad\u0131r devletinden bile geri bir durumda oldu\u011fu i\u00e7in \u201dben devletim\u201d deyip her t\u00fcrl\u00fc halt\u0131 yiyor Kel S\u00fcleyman!<\/p>\n
