Haks\u0131zl\u0131klar\u0131n, zul\u00fcmlerin, e\u015fitsizliklerin h\u00fck\u00fcm s\u00fcrd\u00fc\u011f\u00fc d\u00fcnyada, insana \u201cger\u00e7ek \u00f6te d\u00fcnyadad\u0131r\u201d denmi\u015f, teselli g\u00f6kte aranm\u0131\u015ft\u0131r. Topra\u011fa basar, havay\u0131 solur, suyu i\u00e7er; bedeni de hik\u00e2yesi de d\u00fcnyaya aittir. \u0130nsan i\u00e7in ger\u00e7ek, ancak yery\u00fcz\u00fcn\u00fcn terazisinde tart\u0131labilir. Adaletin g\u00f6\u011fe ta\u015f\u0131nmas\u0131, hem insan\u0131n do\u011fas\u0131na yabanc\u0131la\u015fmas\u0131d\u0131r hem de umudun yanl\u0131\u015f yere sevk edilmesidir. \u00c7\u00fcnk\u00fc umut, g\u00f6kten indirilen bir l\u00fctuf de\u011fil, ya\u015fam\u0131n i\u00e7inden do\u011fan bir ba\u011fd\u0131r; insan\u0131n en temel i\u00e7g\u00fcd\u00fclerinden biri, neredeyse varolu\u015fun nefesidir. Umut yoksa insan yoktur; umut koptu\u011funda ya\u015fam ba\u011f\u0131 kopar, karanl\u0131k ba\u015flar. Bu ba\u011flamda adalet ile umut ayn\u0131 damarda akar. Adalet, umudun toplumsal bi\u00e7ime b\u00fcr\u00fcnmesidir; umut, adaletin i\u00e7 nefesi. Umut olmadan adalet talep edilmez; adaletin imk\u00e2n\u0131 hat\u0131rlanmaz. Sanat nas\u0131l \u00f6l\u00e7\u00fc, denge, ritim ve sezgi gerektiriyorsa, adalet de \u00f6yle gerektirir. Sanat\u00e7\u0131 malzemesini\u00a0 -renk, ta\u015f, s\u00f6zc\u00fck, ses-\u00a0 nas\u0131l sab\u0131rla i\u015flerse, adaleti kuran toplum da ili\u015fkilerini, kurumlar\u0131n\u0131, dilini ve belle\u011fini sab\u0131rla i\u015fler. Yaln\u0131zca kural yazmak yetmez; insan\u0131n ac\u0131s\u0131n\u0131 \u201cduyan\/g\u00f6zeten\u201d, onu d\u00f6n\u00fc\u015ft\u00fcrmek i\u00e7in yarat\u0131c\u0131 \u00e7\u00f6z\u00fcmler \u00fcreten bir adalet gerekir. Bu y\u00fczden adalet, mekanik bir da\u011f\u0131t\u0131m de\u011fil; <strong>ya\u015fayan bir duyarl\u0131l\u0131k<\/strong> ve <strong>yerinde bir \u00f6l\u00e7\u00fc<\/strong> meselesidir. Umut burada hem kaynak hem y\u00f6ntemdir. Ya\u015fam\u0131n malzemeleri -ac\u0131 ve mutluluk- umutsuz b\u0131rak\u0131ld\u0131\u011f\u0131nda ya i\u015fkenceye ya da bo\u015f hazza d\u00f6n\u00fc\u015f\u00fcr. Bir \u00e7ocu\u011fun y\u00fcr\u00fcmeye \u00e7al\u0131\u015f\u0131rken defalarca d\u00fc\u015f\u00fcp kalkmas\u0131 gibi; bir toplum da adalet ararken defalarca t\u00f6kezler, ama umut olduk\u00e7a aya\u011fa kalkar, yeniden dener, \u201cdaha adil\u201din pe\u015fine d\u00fc\u015fer.<\/p>\n<p>Sanat, bu s\u00fcre\u00e7te adalet ve umudun dili olur. Burada sanat ba\u011f\u0131ms\u0131z bir tema de\u011fil; adalet-umut damar\u0131n\u0131n i\u00e7 sesi, g\u00f6r\u00fcn\u00fcr k\u0131lma tekni\u011fidir. Sanat\u0131n g\u00f6revi \u201columsuzu olumlamak\u201d de\u011fildir; olumsuzu <strong>d\u00f6n\u00fc\u015ft\u00fcrmek<\/strong>tir. Sanat, ac\u0131y\u0131 yaln\u0131zca te\u015fhir etmez; ona bi\u00e7im verir, anlamland\u0131r\u0131r, yeni bir g\u00f6rme, duyma ve d\u00fc\u015f\u00fcnme imk\u00e2n\u0131 yarat\u0131r. Adalet de i\u015fte b\u00f6yle \u00e7al\u0131\u015fmal\u0131d\u0131r: Haks\u0131zl\u0131\u011f\u0131 ink\u00e2r etmek de\u011fil, onu fark etmek, y\u00fczle\u015ftirmek ve d\u00f6n\u00fc\u015ft\u00fcrmek. Sanat\u0131n iki do\u011fumu gibi; ilki sanat\u00e7\u0131n\u0131n i\u00e7inde, ikincisi eseri deneyimleyenlerin zihin ve y\u00fcreklerinde. Adaletin de iki do\u011fumu vard\u0131r. \u0130lk do\u011fum, ilke ve ideal d\u00fczeyinde: \u201cAdil olmal\u0131y\u0131z.\u201d \u0130kincisi, ya\u015fama dokundu\u011fu anda: bir mahallenin bar\u0131\u015f i\u00e7inde \u00e7\u00f6z\u00fcm \u00fcretmeyi \u00f6\u011frenmesinde, bir kurumun \u015feffafla\u015fmas\u0131nda, bir yarg\u0131n\u0131n yaln\u0131zca yasa metnini de\u011fil, insan onurunu g\u00f6zeten \u00f6l\u00e7\u00fcl\u00fcl\u00fckle verilmesinde. Yaz\u0131l\u0131 ilke, ya\u015famsal prati\u011fe d\u00f6n\u00fc\u015fmedi\u011finde, t\u0131pk\u0131 payla\u015f\u0131lmayan bir eserin \u00f6lmesi gibi, adalet de k\u00e2\u011f\u0131t \u00fczerinde kal\u0131r ve solar.<\/p>\n<p>Toplumun belle\u011fi burada belirleyicidir. Bir eserin kaderi nas\u0131l al\u0131c\u0131lar\u0131n elinde \u015fekilleniyorsa, adaletin kaderi de toplumun vicdan\u0131nda ve al\u0131\u015fkanl\u0131klar\u0131nda \u015fekillenir. Toplum bazen en k\u0131ymetli eseri soka\u011fa d\u00fc\u015f\u00fcrebilir, y\u00fczeyselle\u015ftirebilir, metala\u015ft\u0131rabilir; bazen de unutulmu\u015f bir eseri diriltip kendi ba\u015f tac\u0131 yapabilir. Adalet de bazen kal\u0131pla\u015fm\u0131\u015f bir s\u00f6ylem olarak \u201cher ta\u015f yerinde\u201d diyerek haks\u0131zl\u0131klar\u0131 \u00f6rter; bazen de bir ku\u015fa\u011f\u0131n \u0131srar\u0131yla yeniden anlam kazan\u0131r, nefes al\u0131r. Bu nedenle adalet, salt mahkeme duvarlar\u0131n\u0131n aras\u0131nda de\u011fil, <strong>g\u00fcndelik hayat\u0131n ince ayar\u0131nda<\/strong> kurulur: dilde, davran\u0131\u015fta, i\u015f b\u00f6l\u00fcm\u00fcnde, hak da\u011f\u0131l\u0131m\u0131nda, hatay\u0131 onarmada.<\/p>\n<p>Umutla beslenen adalet, cezaland\u0131rmay\u0131 tek se\u00e7enek saymaz; <strong>onar\u0131m\u0131<\/strong> ve <strong>iyile\u015ftirmeyi<\/strong> de adaletin asli par\u00e7as\u0131 kabul eder. \u00c7\u00fcnk\u00fc umudun mant\u0131\u011f\u0131, y\u0131kmaktan \u00e7ok kurmakt\u0131r; kurarken de cezas\u0131zl\u0131\u011f\u0131 de\u011fil, sorumluluk almay\u0131 ve dengeyi hedefler. Bu, haks\u0131zl\u0131\u011f\u0131 aklamak anlam\u0131na gelmez; tam tersine, ona hakkaniyetli bir yan\u0131t vermek, tekrar\u0131n\u0131 \u00f6nlemek, ma\u011fdurun onurunu ve failin sorumlulu\u011funu birlikte ele almak demektir. Bilin\u00e7 katmanlar\u0131 bu iklimin psikolojik altyap\u0131s\u0131n\u0131 a\u00e7\u0131klar. Bilin\u00e7\u00fcst\u00fc, \u015fimdiki zamandaki fark\u0131ndal\u0131\u011f\u0131m\u0131zd\u0131r; bilin\u00e7alt\u0131, ge\u00e7mi\u015f ya\u015fant\u0131lar\u0131m\u0131z\u0131n tortusu; bilin\u00e7d\u0131\u015f\u0131 ise t\u00fcr olarak ta\u015f\u0131d\u0131\u011f\u0131m\u0131z karanl\u0131k yazg\u0131. Fakat ayn\u0131 bilin\u00e7d\u0131\u015f\u0131, umudun da ilksel k\u0131v\u0131lc\u0131m\u0131n\u0131 ta\u015f\u0131r: hayatta kalma, devam etme, yeniden ba\u015flama itkisi. Dil de\u011fi\u015fti\u011finde, d\u00fcnya de\u011fi\u015fir: \u201cKurban\u201d dedi\u011fimizde bir t\u00fcr pasifle\u015ftirme \u00fcretiyorsak, \u201cya\u015fayan\/direnen\u201d dedi\u011fimizde \u00f6zneyi geri \u00e7a\u011f\u0131r\u0131r\u0131z. Her insan, g\u00fcndelik hayat\u0131nda minyat\u00fcr bir adalet zanaatk\u00e2r\u0131d\u0131r: \u00e7ocukla kurdu\u011fu diyalogda, i\u015f yerindeki payla\u015f\u0131mda, trafikteki sab\u0131rda, kom\u015fusunun hakk\u0131n\u0131 g\u00f6zetmede\u2026 K\u00fc\u00e7\u00fck teraziler, b\u00fcy\u00fck adalet iklimini do\u011furur. Bu iklimin rengi ise <strong>umuttur<\/strong>: umudun \u0131\u015f\u0131\u011f\u0131 olmadan terazi terazilikten \u00e7\u0131kar; k\u00f6rle\u015fir, ta\u015f kesilir.
